    Okay guys, I hope these aren't stupid questions but I am mentally prepared for the barrage of abuse I may get lol so here goes:


    I have said on a previous post that I'm not computer literate and that still stands I have learnt how to post here, I understand the one thread etiquette, I know how to quote others in reply and i've even uploaded an image but what I want to know is if I had to post something lengthy like a defence etc could I write it in a word doc and then "copy and paste" here.


    This I presume would be helpful for making alterations without having to write it all out again?


    Also do I need a government gateway ID in order to acknowledge a Court claim, I read somewhere it takes 7 days to validate an ID?? this would maybe give me less time to do AOS etc?? I'm sure plenty on here have done one so quick answer will be great.


    And on a final note following CM,s suggestion I sent a strongly worded letter to Excel telling them about the lack of POFA compliance in the NTK they sent me and giving them a few examples of court cases showing no keeper liability. I also totally rebutted their citing Beavis on their DRP drivel letters with quite a few FACTS!! I'll see how they respond to that if they even bother of course.

    Yes, you can copy and paste.

    Yes you do need to get that ID! You should already have done so - youre burning time you dont have.
    Actually ACKNOWLEDING the claim is a five inute process.

    You could try it and see what happens. You don't have to submit your post if it doesn't look tight.

    So as some of you know I have been in correspondence with my local MP and after getting the "fob off" from him I wrote to him again and have just received a further letter from him.


    It makes for good reading and frankly astounds me how he's assuming I have no idea what I'm talking about, this could indeed be true but with all the information I've picked up here I think a letter back to him pointing out MORE facts is what he's gonna get lol.


    This doesn't alter my objective fighting Excel but I wondered what you all think of his reply, i'll give you the crux of his letter:


    "Thank you for letter blah blah, I note from your previous correspondence that you are questioning the legal/authority of Excel parking to issue PCN on behalf of Peel holdings. If this is the vein in which you are continuing to contest the PCN then I AM AFRAID I AM UNABLE TO ASSIST (not in bold by the way, just me highlighting salient points), AS A COMPANY EXCEL PARKING ARE NOT GOVERNED BY THE FREEDOM OF INFORMATION ACT (really????) and are therefore not required to provide you with the information you are requesting.


    Indeed I have been successful in some of the cases I have contested because of evidence which provided the PCN had been issued incorrectly.


    Unfortunately the majority of constituents who contact me requesting assistance in challenging PCN,s ARE NOT SUCCESFUL (Presumptious?) In most cases people who claim unfair penalties say they were not aware they had to buy a ticket and others, SIMPLY have not read the T&C,s. THESE ARE NOT GROUNDS FOR AVOIDING A PENALTY CHARGE (seriously??).


    I would be happy to write to Excel parking on your behalf if you are able to provide me with evidence of why you should not have been issued with the PCN.


    If you are unable to provide me with this evidence, then i'm, afraid I cannot assist you further on this matter".


    That is more or less his reply, I found it amusing initially but then thought hmm he's actually insulting my intelligence and so I will reply to him starting with Excel's PCN is NOT!!! POFA compliant, is that enough evidence for you???


    I'm only looking for opinions people not what to write back although your all welcome to tell me what you would write in my position, at least he has had the courtesy to correspond with me.

    the MP is correct , the FOI does not apply to private parking companies, only government organisations

    you can drop an SAR bomb on the ppc using the GDPR 2018 however

    the MP will likely tell you that POFA2012 is not mandatory

    I can understand why the MP would want a clear indication of why the pcn is not valid , but they may take the view that a judge can decide

    I do not believe that the MP can or will get involved without a clear indication of whay the EXCEL case is so flawed , many MP,s have been ignored by PPCs as can be seen in the government debates on this

    we normally ask an MP to support Sir Greg Knight and the new Private Parking Bill

    by all means keep it up if you feel you can get somewhere, but you definitely need to concentrate on the facts and what matters and is true, not talking about issues they cannot control, or where companies do not have to comply like the FOI request for example

    I do not believe that the MP is insulting your intelligence, but is pointing out your lack of knowledge and requests that are clearly fantasy like the FOI one

    if using your intelligence then you need to give them some meat in the sandwich , something to chew on , something to mull over, preferably backing up your complaint with evidence

    from the reply you got, it seems they know more about this than you do, which is a shame because I would have hoped that any complaint you made would have had the facts in it that could not be refuted, whatever those facts might be
  • I've just realised what I've done, I have mixed up in my head FOI and POFA duh!!!!! yes Redx your right about my MP,s quotes in his letter.


    I will have a re-think before I compose anything back to him, I still find it hard to believe that any one receiving a PCN doesn't seem to have any right of reply when they have asked a legitimate question of the PPC and they just blatantly ignore it and press on with debt harassment, fake legal letters and eventually a claim.


    Is it not possible in any way shape or form to ask a question of a PPC and get an answer, it appears not from what I keep seeing.
