Since in this case there was no dispatch confirmation there was no contract between you and us. In a small number of cases this dispatch confirmation was sent and we therefore fulfilled those orders.

It also says they won't take payment until dispatch, so therefore if they took payment that would indicate they had been dispatched, therefore contract formed

Virgin Megastores (Zavvi) has had this coming to them for a long time. Their customer service is dire to say the least and I too do not agree with them taking peoples money and earning interest off it for about two weeks without any explaination. It was only until they were challenged that they offered an apology and a £5 voucher which nobody has recieved so far. They took peoples money so the contract was formed and i believe they should honour all orders in which they took money from their customers and take it on the chin. Play managed to not charge anyone for the £2 laptop bags and informed people within two days... why can't virgin?

I emailed them about them breaking the contract and that i was !!!!ed off about no reason sent for the cancellation. I'm sick of virgin, they messed me about last time and i was hoping to get one over them but as long as I recieve a refund and they get sued a few times then i'm happy :rotfl:
