  • I still have a problem with this, as they took the money from me 11 days after I placed my order. I've just been on the phone to CS, and was told that this was on offer 3 weeks ago for £6.99. He said this after saying it was a misprice. He said he was not aware of anyone who ordered on or after the 1st November getting this set for that price (told him they definitely have). He said there was nothing they could do because they couldn't physically sell this set for that price, as it would leave them out of pocket. Wonder how they managed to sell it at that price 3 weeks ago, then (when it was on offer, not a mistake). I told him that their site states that money will only be taken when the item is ready for despatch - he said it was ready for despatch when the money was taken from me. I have told them I will be taking them to SMC, as I am fed up to the back teeth of online retailers thinking they can do this. See, as I just explained to Zavvi, had they not taken the money 11 days after I placed the order, changing my order from back order to in progress, I would not be as annoyed as I am now. It's due to them taking the money almost 2 weeks after i placed the order (by which point they should have easily spotted the mistake, as they claim it to be), that I want to issue proceedings. I'm waiting for a call back now, as they said they would like to sort this out without me issuing a claim against them. They did try to fob me off with what TS has told them, but TS deals with Consumer Law in relation to criminal matters, not civil matters. If I don't get what I want (doctor who boxset), I will take them to court and let a judge decide whether their actions were reasonable. Doesn't cost a lot to take them to court, and it's a matter of principle now.

  • Good on you!!! Let us know how you get on. My situation with ordering this was exactly the same as yours, it was back ordered then went to progress 9 days after i placed the order taking the money from my account then 5 days later its refunded before the explanation which i received 3 days after the refund! Not good customer services at all but hey i can't be bothered to fight it.

    I was once told by a lawyer that the very last thing one should ever do is go to court on a matter of principle!!

    Just accept it and move on for God's sake - you are wasting so much of your life over £30 when you could be doing so much more!
    You don't get medals for sitting in the trenches.

    A store does not have to suffer loss due to an error made by another party. You can't force traders to sell you something at an advertised price if they realise the mistake before you pay up. But once the contract has been concluded they shouldn't go back on it. The trader might argue that the mistake was obvious, thus making the contract void, but you should definitely get a full refund.

    It's also worth notifying your trading standards department, as, by law, traders are required to quote correct prices.

    The terms and conditions on the site are clear on when a contract is formed between you and us:

    Contract Formation

    When you place an order to purchase a product on our website, your order is an offer to purchase those products. We will then send you a confirmatory e-mail setting out the details of your order. A contract will only come into existence in respect of each of the products ordered when we send you an e-mail confirming that we have dispatched those products to you.

    Since in this case there was no dispatch confirmation there was no contract between you and us. In a small number of cases this dispatch confirmation was sent and we therefore fulfilled those orders.

    We have apologised and we are sending you a goodwill voucher. We realise that this is very frustrating for you and we are sorry, but there is no more we can do.
