    Hello everybody, I received letter about mediation about the same, which started I believe more than 6 years ago and I filed defence via MCOL 4/10/2018. I am sure it was written at a time there something like the court should be within 28 days if they want to go further after my defence, I am not sure, it is 2 years ago, but I am sure there must be some time limits as for 6 years since ''offence'' committed, isn't it? Also I am sure there must be some time limits as for after filing defence on MCOL without any further action.?

    Is the DQ in your possession and is it from the CCBC?  If yes to both, then it needs completing provided it is about a claim that is not out of time, i.e. not more than six years since the parking event.

    Sounds like you have a Directions Questionnaire regarding a 2018 case.  We've seen several this week - extremely unfair on Defendants - and you will have to go back and read what the NEWBIES thread tells you to do at DQ stage, then get ready to do your WS & evidence.  


    I am glad you came back here now because we want consumers to pour their heart out while the Government is listening.  Maybe you can suggest the Government makes changes to the CPRs so that the rules stop parking firms from 'parking' a claim and that they have to file it within a year or two of the parking event and cannot then let it lie dormant/stayed for more than, say, 6 months.  There is scope to add anything you want to improve the plans for the 'WIDER FRAMEWORK' (changes to the PAP wouldn't fall within the Code of Practice, I shouldn't think, but anything PPC related can be suggested to Govt within 'Wider Framework').

    The Government is (this month only) consulting about a new statutory code of practice (CoP) and framework to rein in the rogue parking firms.  Read and comment on the draft CoP proposal and the enforcement framework consultation, and get everyone you know to do the same.

    You will need to register to comment on the CoP and enter an occupation even if you are retired or a homemaker, but otherwise it is easy to navigate, and comment upon each section/subsection individually. You can save comments to edit later and or submit comments once you are happy with them.

    At the very least, we say the parking charge level should be £50/£25 or higher level £70/£35, as per Council PCNs in E&W.  

    And we say the added fake 'debt recovery' costs are just double counting the cost of letters, and MUST GO because that is unfair and illegal.

    Hi it seems to me it is out of date going back to when I first started it seems it has happened in 2013, as 02/2014 was Popla appeal I believe and after MCOL defence I got rid of all paperwork.

    Yes it is from CBCS from some deputy disctrict judge from Northampton, saying that court will deal with the application to lift stay without hearing under CPR 23.8(c) I have by 28.9 complete Small Claims Directions Questionnaire ( Form N180) and file it with the court office - Northampton address

    Did you mean CCBC?  What is this about lifting the stay?  What is your timeline from date of parking event, through PCN, letter of.before claim and original claim form?  Are you sure this DQ is concerning the same original case?

    As you have thrown away all the paperwork, sending a Data Subject Access Request to the Claimant's Data Protection Officer might be prudent.

    You also might want to phone the CCBC - following up with an email - asking if they can possibly send you a copy of the Claim Form and a copy of the Defence that you filed.

    So I received by post General Direction Order in the County Court Business Centre- claim No the same like in MCOL, seems the same case as BW legal been trying to obtain money...Apologies have 2 small kids now at home, am looking into if I have copies of communication somewhere, but this was the only one I received so believe is out of date anyway, but will be back once I find some more info.
