DId you send to Excel as well, hard copy through post or email? Did you check they accept service via email?

    Yes, you turn up
If you dont, even if they also dont turn up, youre reducing your chances of winning quite considerably.

Don't make assumptions, but assume they will send somebody and always turn up even if it's only to argue costs

As soon as the CCBC sent paperwork to the local court, they are finished with it, their job is to send out paperwork and allocate the court

Your local court sent you the court order with completion dates and the date of the hearing in front of their judge

Excel should inform you and the court if they are not attending, if they fail to do so then ask the judge for punitive costs due to unreasonableness by the claimant

This is also why you email them as well, like mentioned above

    It's called a discontinuance.

Thanks, is there a way to check if they have before the hearing date?

    Yes. Call the court.

The Claimant should of course send you a copy of any Discontinuance Notice.

Thank you to all, is it just a waiting game now until the hearing date?

    Moslty a waiting game

If you have THEIR "WS", you need to rip it to shreds - all the added things that arent in a WS such as legal cases, new legal arguments, assertions with no evidence to back it up, etc.

Update: frustration this evening whereby following submitting my witness statement, the claimant has sent the following regarding the leaseholder witness statement not being valid during the time of the PCN being issued.

I feel like they have just scrambled and thrown together the below with a date extension of 09/10/2023.
Accompanying letter just says admin error and apologies to the court.

This was one of the main points to bring up on hearing date, and feel some ammunition has now been lost. Any advice or response would be greatly appreciated.

Hearing date is next Tuesday 3rd September, so also feel this is very late by the claimant.

You could check this out on the Land Registry website. It will cost £3.00.
