Catastrophic engine Failure 4 days out of warranty please help:(

Hi guys ,
I purchased a car from what I thought was a reputable dealer I looked at reviews as I wanted to be sure!
The car was viewed by myself and family and I then test drove the car.
I was very happy at time of purchase and paid via bank transfer £7750.00 the car had done
The car was brought with full service history , 1 year MOT and 3 months warranty with warranty assist.
On my way to work at 0530 on the motorway the car juddered abs light came on then oil light came on red all within 30 seconds the car cut out and I glided over to the hard shoulder.
My car was collected by breakdown took to my place of work as I had to earn a living and then after work I called a removal truck to take to closest garage for inspection.
On inspection the mechanic stated it was catastrophic engine failure and would cost thousands to repair.
I called up dealer and was polite and told him what had happened he told me to call warranty assist I did and they basically said it was out of warranty by 4 days and they couldn’t help.
I have written an email to dealer as I want things in writing now as evidence.
I stated the consumer sales act the car is not fit for purpose and not satisfactory.
He has then emailed back saying he is sorry this has happened he is not in breach of contract and sold me a good car and not liable for any repairs or refund.
Now what can I do I’m gutted, I’m just so glad wife and son were not in the car at time.
Any help is greatly appreciated.

    What was the cause of the failure?

    "Catastrophic engine failure" doesnt tell you much...

    Also make, model, age, mileage, service history of car, has it a timing belt and was it changed on schedule?

    The engine has seized solid.
    The independent garage said there will be significant damage inside the engine. The oil basically came out engine and car cut out on motorway.
    To inspect further will be more cost to me.

    How many miles have you done in the car? how many miles since the last service?

    Engine seized after 3 months and 4 days after purchase due to no oil.....was it a slow leak or did it dump all its oil all over the motorway? Did you notice any blue/black smoke out of the exhaust behind you before the light came on?

    Have you been checking the oil weekly and is there any oil on your drive or where ever you park it, you would notice 3+ ltrs of oil if it was on the ground?

    They have to prove the fault wasn't already.

    Lucky you have your £12K incase of emergencies - this may be one of them.

    They should at least be able to tell you how the oil got out of the engine - assuming it was a catastrophic oil loss and not a gradual usage issue.

    As has been said, it would be up to the supplying dealer to prove the fault wasnt present at the time of sale - they might argue that as the car was inspected by them, sold by them and drove for three months that it wasnt. Be prepared for that.

    Your missing the point, it was a new car to the OP and only bought 3 months and 4 days before it ran out of oil, and it had a years MOT - so it must last for at least a year, right?
