    The ppcs do monitor this forum and can use posts in your thread against you if they can identify you

    Also you still haven't edited your posts throughout the thread giving details of who was driving

    Take the time to go through them and use the third party to describe what happened as in the driver did this/, the keeper did that
  • Looking through all the pictures etc they have sent me, I dont think I can argue it! I already said there was an overstay, I just don't understand how £100 justifies it?!

    the default charge on the signs for breaking any rule will state £100 (or less)

    the lower tariffs payable by PDT or phone or paypal etc are the compliance charges for where no rules have been broken including only being on site for the time paid for and little or no more

    the £100 maximum tariff as a default tariff has been that way for almost a decade and is for both free and paid for private car parks, it is the punishment charge for breaking any rule

    look at the signs on a bus like Stagecoach or First and it may say that the "standard fare" is £20 or £50 or £100

    but a dayrider may be say £4.20 , so a compliance fare is lower than the "standard fare" that a fare dodger or an underpayer would pay , so pay a junior tariff when you are actually an adult and the "standard fare" applies

    you will find similar signs on Metrolink too , perhaps with different rates, ditto for Northern Rail as well

    ps:- even the judges in the Beavis case decided on £85 (had it been £100 on that car park then maybe they would have agreed with £100 , who knows ?)

    in your case , either its an overstay , or its an underpayment which resulted in an overstay , but either way they are saying the defendant did not purchase enough time compared to their observation times , hence the standard fare applies of say £100 and they want this paid IN ADDITION to what was paid on the day (which is effectively forfeited)

    Read the news, there was a woman who paid for a Jet2 flight to Turkey and was a disruptive passenger so the flight turned back and was escorted by the RAF, she has been invoiced for 85 grand by Jet2 plus a lifetime ban, she won't be getting her flight rebooked or a refund either

    That first image you have shown doesn't look like a photo of a sign on-site. It looks more like a mockup of sign.

    It also shows that the parking charge of £100 definitely isn't prominent - as it needs to be post-Beavis.

    So they will expect payment of £8 for up to 6 hours

    Their small print says the Driver agrees to pay £100 if they fail to comply

    It also says extra charges are payable beyond the paid for period too

    What makes you suddenly think that a Registered keeper can't argue:

    - that the signage is wordy and the £100 in minuscule print, and that sum is not listed at all at the point of sale at the machine, where the phone transaction took place

    - that this is a distance contract (paying by phone certainly is) and no terms or info was communicated in the texts abut any grace period or contravention penalty, or any obligation apart from paying the tariff

    - that the overstay was unproven (unsynchronised clock, clashing with the PDT machine clock and seemingly exaggerating the timeline) and well within the IPC Grace period during which enforcement cannot take place.

    Obviously in a court defence you will be using one of our pre-written examples as a base.
