Update: so i had court this morning anddd i won!!! So glad it is all finally over!
I turned up at ipswich court half hour early and the usher told me to go wait upstairs and that the rep from the other side was already there and that she wanted to have a talk with me. When i got up there, there was a few people in the waiting room and i guessed which one was her as she was in a suit quite young and was the only one sitting on her own. So i sat away from her and was not going to talk as iv read on previous court reports that they try to talk to you before you go in. When it was time to go in the usher asked her if she wanted to talk to me before we go in to which she replied no its ok. It was a male judge cannot remember his name nor hers! We both sat down he asked if we was ready and then said that as the person from Cel who had writ the WS wasnt here it puts them at abit of a disadvantage as the rep couldnt answer questions on that as she wasnt the person who signed the statement of truth. He then asked the rep to state her claim. She explained it and that theyd writ a load of letters to me including a offer of a reduced amount and that id ignored them. He pointed out to her a fault in their witness statement refering to me as a 'he'. He then asked me about any questions i wanted 2 ask them. I said about the evidence from the surgery and that the surgery didnt support them. And then my name was brought up and i mentioned that on all the letters from CEL they had called me by my first name and one of my middle names, my last name was not on any of the papers theyd sent me. To which he asked the rep why is this, and she explained thats what theyd got from the dvla and i said thats not what it says on my drivers licence, he asked to look at my license and then said to her il give you one more chance to explain this. She replied that i could have changed my name or have got married in that time and didnt report it to them or the dvla, to which the judge smirked and ask me did you, and i said no and he said that i was under no obligation to report it to cel even if i did. Then he said to the rep i gave you a chance you've sued the wrong person an the claim is struck out! After he said that she asked about how to appeal and the judge told her she'd have to talk to someone downstairs. all in all i was in there for about 15 minutes, and it wasnt at all as bad as id thought itd be. He asked about costs and i got my carpark ticket and travel back. Im soooo glad this is all over (hopefully) do you think theyl appeal? Thankyou to everyone on here thats helped! Im also glad that i got a young rep probly as old as myself, who was rather quiet.0 -
Well done. I doubt they'll appeal, the fee is quite high, there has to be a point worthy of appeal (mistake of law/fact, wrongly exercising discretion) and they tend not to take many cases to court in the first place. If they appeal, they have to first of all get permission and this is a paper application and they may well fail at that stage anyway. Updating your licence does not update your V5C - or vice versa.
Well done on winning though. :TPlease note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
