    you could do , or change it from DRIVER to an OCCUPANT OF THE VEHICLE

    I would also be stating that at no time was this person made aware of the requirements to input a VRM into an IPAD inside the building, so poor and inadequate signage also caused this issue

    why not post your proposed appeal in full below so we can critique it more easily ??


    ps:- as waamo says , there is no legal compulsion to name the driver, yes they can ASK, and you can refuse , a bit like the 5th amendment in the USA

    I appeal and dispute your 'parking charge', as the keeper of the vehicle. I deny any liability.

    There will be no admissions as to who was driving and no assumptions can be drawn, nor was there an agreed contract. Your signage terms fail the test of 'large lettering' and prominence of the parking charge, as established in ParkingEye Ltd v Beavis, which is fully distinguished.

    Should you fail to cancel this PCN, I require the following with your rejection letter:

    1. All images taken of this vehicle & the signs at the location that day. Do not withhold any images or data later relied on for POPLA/court.

    Firms of your ilk were unanimously condemned in 2018 as operating an 'outrageous scam' (Hansard 2.2.18). The BPA & IPC were heavily criticised too; hardly surprising for an industry where so-called AOS members admit to letting victims 'futilely go through the motions' of appeal and say on camera 'we make it up sometimes' (BBC Watchdog).

    I will be making a formal complaint about your predatory conduct to your client landowner, as well as complaining in writing to my MP and ensuring that they are appraised of the debate where Parliament agreed unanimously: ''we need to crack down on these rogue companies. They are an absolute disgrace to this country. Ordinary motorists...should not have to put up with this''.

    Formal note:

    Service of any rejection letter/POPLA code and/or legal documents by email is expressly disallowed. All responses to me from this point on, must be made by post. Regardless of any MCOL online/email system, service of any court claim must only be made by first class post to the latest address provided by me.

    In order to resolve the dispute I attach a copy of the gym log from the occupant of the vehicle showing they were at an induction at the time. At no time was this person made aware of the requirements to input a VRM into an IPAD inside the building, so poor and inadequate signage also caused this issue.

    that template seems ok to me , so if nobody else objects , appeal it using the template , as keeper, carefully checking that they dont hoodwink you into admitting who was driving in any drop down selection boxes or in any letters or emails or paperwork

    try using KEEPER or OTHER or similar if using their website

    if they issue a phishing letter for the drivers details, IGNORE it and wait for a cancellation or a popla code

    they may well cancel it as soon as they see that template above

    you would only owe £85 if a judge says so, not before

    Tick here to confirm that you were the driver and that the PCN you have received contains the correct information
    Tick here to confirm that you were not the driver or that the PCN you have received contains incorrect information

    So I will appeal by post instead.

    I did warn you about their tricksy ways, these companies stop at nothing to try to wheedle the drivers details out of people

    the problem with the post is that even if you get a free cert of posting from the PO Counter , they could just ignore it and then you have an uphill struggle


    we dont tell people to send it "signed for" as they can refuse to accept it


    therefore, use that second option on their website and appeal it online


    remember, we know all about their tricks, all of them, so dont make any assumptions on what you should do , be guided at every step by the regulars on here who know what needs to be done


    appeal on line using the second option, appealing as KEEPER if asked , and using your amended template above (same as we tell everyone else to do)
