Help, sorry, the though of losing 85 quid has thrown me into a blind panic and nothing in the pinned post makes any sense. This is not the fault of the FAQ author, I'm just totally overwhelmed by it all!
I was at Pure Gym in Bristol on my first day at an induction and didn't know that the driver is supposed to add the cars registration number to an ipad. The ipad has no signage on it at all. The website says "To claim your free parking, enter your car registration on the terminal inside the club every time you visit." but the driver didn't think to check that before going.
Highview parking have sent me a charge notice for an hour and have photos of the car and numberplate. They say they will reduce the charge to £50 if I pay it within 14 days.
I cannot work out if this is legal, if they have any right to charge me or if it is worth fighting them.
I called PureGym who said 'didn't you read the website?' (no!) but they will send through a log of gym times.
Any advice would be much appreciated! The text at the bottom of the letter says :
"Following the landmark Supreme Court ruling of Parking Eye v Beavis it has now been established that a Parking Charge Notice issued on private land is enforceable. The Court rejected claims that such charges are extravagant, exorbitant or unconscionable and advised that such charges act as a necessary deterrent for breach of contract. If you feel you have sufficient grounds to appeal this notice you will find full details of the appeals process overleaf." They give an email address and say that is the best way to appeal.

It's almost an insult to the FAQ author to say the faq don't make sense!
Go back and take your time understanding just #1 to begin with
Throughout you are advised never to reveal who was driving
You need to edit your post to remove details of who was driving
The ppcs monitor this forum and can use posts against you0 -
edit post #1 as to what the DRIVER may or may not have done on the day
then use the template appeal , adding a paragraph that states that THE DRIVER was a legitimate patron of the gym that day
as mentioned above, only a fool starts blabbing about who was driving on the day, so be smarter than that
a keeper has more legal rights than a driver
and yes, a PPC can issue an invoice if parking rules are not complied with
in fact they issue something like 5 million or more a year , which rises year on year0 -
I assume that as the gym are being totally unhelpful you have been in and cancelled your membership, and told them why?0
 -
Just cut and paste the template in post 1 of the Newbies thread. That's all you have to do at this point.
Then take the next few days getting your head round it.0 -
Thank you, I have edited the post to make it clear it is not the fault of the FAQ author, it is all brilliant but there is so much info I just don't know where to start.
Have I said anywhere that I was driving? I have said I was at the gym but I didn't mention who was driving.0 -
The gym were ok on the phone, they said they would send through a log so I can prove mmbership. It is a very cheap, no frills gym and I'm on a £40 for 3 months membership which I don't think I can cancel or get the money back from anyway. They don't seem to have any say when it comes to parking.0

just edit post #1 to state that an occupant of the vehicle was at the gym blah blah
no need to tell us chapter and verse and parking companies do read these forums, you dont even need to be a member to read posts on this forum
then appeal it as KEEPER using the template letter , the one size fits all template that told you that the circumstances on the day do not matter
if HV failed POFA2012 , in timescales and/or wording, then a keeper isnt liable , in which case WHO CARES about what happened on the day ?0 -
Thanks everyone. I am taking deep breaths. I found the template and I can see what you mean by not knowing who the driver is. The letter says "you should provide us with the name and current address of the driver" if you were not the driver.
It says the driver has contravened the signage. There is signage saying that parking is free for PureGym members but nothing to say how you activate that. Unless you look on the website.0 -
They will ask you who was driving at several points. It's a fishing trip for them. Don't get hooked.
The keeper has an absolute right to appeal.0 -
            Can I put
"In order to resolve the dispute I attach a copy of the drivers gym log showing they were at an induction at the time and were not aware they had to register the cars details."
The gym log does not show a name but it does clearly show that the gym induction was at the time the ticket was issued.
