Court Claim - AoS Complete

Options
Hi,
I need some support with my defence.
I've completed the AoS after receiving the court claim dated 29/05/18.
2 hour maximum stay retail car park, I returned to the vehicle around the two hour stage but it took me a further (I think) 14 minuted to exit the car park due to traffic. This is due to a badly designed one-way system car park which left lots of cars queuing to get out as well as there being excessive traffic on the road outside of the car park. The main reason for overstaying on the premesis was that traffic on the road outside the car park was exsessive and caused a long queue in the car park itself.
Hope you can help!
You seem to know your stuff @Coupon-mad :A

TIA,
Tom

If you use the search function at the top of the page, you can put search text in the advanced search, changing from "threads" to "posts" and see what defences other people in the same position as you did.

If this were to go in front of a judge, the PPC would, imo have an uphill climb.

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

Hospital car parks and residential complex tickets have been especially mentioned.

The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas.
You never know how far you can go until you go too far.

Please avoid the gobbledygook infecting your posts by switching off Smart Punctuation on your iOS device.

Go to 'Settings' > 'General' > 'Keyboard' > 'Smart Punctuation' and flick the switch off.

Switching off seems to have no detrimental affect on any other use of the keyboard.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Search the forum for ParkingEye grace periods defence and also look at the ones in the NEWBIES thread as I recall writing a PE one (different circs, Odeon cinema with an iPad) that has the necessary words I suggest using to say the claimant has not complied with the ICO ANPR surveillance camera rules.

That defence point is already written and linked in the NEWBIES thread and you'd just need to amalgamate it with a typical 'grace periods' one.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top of this/any page where it says:

That's great, thanks for the pointer.

I read something about not submitting a defence, was that just initially, ie. not before AoS?

Follow post 2 of the newbeis thread exactly. You follow this exactly, rather than half remembering something, and check there first before posting queries :)
