Write to tell us the story in the third person, not saying who parked:

'the driver did this... the bay was... there was/wasn't a disabled person in the car...'
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Just cut and paste the template in the Newbies thread. It's in post 1 and it's in blue. That's it. All there is to it.

If you can't do that I will walk you through it. Not tonight though it's late.
  • The driver broke their leg recently and needed surgery and has a plate and a number of pins causing difficulty while walking for the time being. The driver uses a cane to walk until it is healed and was advised by a family member that disabled bays are not enforceable on private land. The driver appreciates that they do not have a blue badge but thought on this occasion it was fair, however mistakenly that may be.

... and now the keeper has received a speculative invoice (PCN) through the post from UKCPS.

And so the OP should complain to the landowner and point out their temporary disability and ask that the landowner cancels the UKCPS PCN - has to be done quickly.

UKCPS usually allow their client to cancel a few per month within 2 weeks or so of the PCN.

Here is a link to a short post that contains the template you need. Just cut and paste it. Then send it to the parking company.

Yes this stage is as simple as that.

Then contact the landowner asking if they will cancel the ticket. You've made a start on putting something together already.

Here is the template for the parking company

Were this to get to court a judge may well agree with you that, at the time the event took place, although not qualifying for a Blue Badge, you were disabled, and were thus entitled to reasonable allowances because of your., disability. Read this

    https://www.gov.uk/guidance/equality-act-2010-guidance.

    also, complain to your MP.

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

Hospital car parks and residential complex tickets have been especially mentioned.

The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas.
You never know how far you can go until you go too far.
  • When I go to the website to make my complaint, there are a number of photos including one of the signage and plenty of the car. Does this matter considering the template letter asks for copies of these?
  • And secondly, sorry to double post again, should I to write about the driver in the third person when contacting the landowner? Thanks.
