And just as side note, i got another ticket the next day. So in the same place and I will be filing the same defence to that Defence as they are taking me to court for that ticket also.
Search the forum for res judicata and stop letting them file two claims and wasting court time and your time/costs, twice.

You need the Court to be made aware in your WS and ask for the claims to be merged into one hearing.

Do the search, this is not OK. They can't try twice for a case turning on the same facts.

  • Sounds like a plan. Thanks again Coupon!
  • Seems I missed the date for the second Claim and I had a default judgement against me.

So I'll be paying that as its my own fault for missing it.

    On to the 10th :D
  • Hi, I don't know how to go about asking for advice as I am new to this. I don't know if anyone can help me.
The driver of the vehicle moved into a flat that has secure parking. When signing tenancy agreement he/She asked about a permit and was told one wasn't needed as the space came with the property.
In total 11 tickets have been issued by link parking. The fines were appealed against and lost. The tickets and follow up letters were passed to agent who said they would sort them.

Now a notice before claim has come in the post. I have phoned them and explained but the advisor basically said tough.

These aren't the first fines received so I am wondering if the agents got some written off.

    What can be done?
Some are saying Gladstone won't win and others are saying the courts will do paper hearing only and side with them.
    11 tickets at £160 each isn't a laughing matter.
    Please Help.
    Tia

You need to read forum help (above, next to 'etiquette' in a tab on the left). You need to see how to start your own new thread and read the sticky threads first.

PLEASE delete your question, you cannot hijack other people's threads about their case, it is unfair to jamieh1985.

Please edit and delete it above, now please, and read the FORUM HELP and video and on how to use this forum.

I will then delete this reply as this is taking jamie's thread off topic.

  • So my court case is tomorrow.

I'm assuming I just turn up and remember the points I made in my defence. Thus getting away with the invoice?

Read up on Right of Audience in case you can challenge the other side's rep at the start of the hearing

Bring all your docs/previous correspondence with you - don't rely on your memory! It is never a "given" you will "get away" with it

No Witness Statement? It'll be a short and expensive visit.
