    Hi Guys

    So I have my Directions Questionnaire back from the court.

    The institutions found here are very clear and I am following them. However one question I have. Point 5, talks about transferring to my local court. But I do not have time to attend a hearing. So should I change some of the points made in 4m mostly that Gladstones are currently including a `request for special directions` asking the court to hear the case of the papers only, without an oral hearing? Or I want an oral hearing?

    Off Topic:
    But I have another Letter of claim in the post for a different ticket when the car was parked the day after this ticket was issued. I cannot find any information on what to do about a Letter of claim. I assume I should write to the bwlegal and give them my reasons why I won't pay the invoice?

    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    It is definitely to the advantage of the claimant to allow this to be dealt with by way of papers and no hearing


    If you still want to do this then it's irrelevant where this takes place as neither side will be going!

    You want to lose? NO, not at their local court (you would be expected to travel there!) and NO not 'on the papers'. Absolutely NO-ONE agrees to that.

    You can't find bargepole's 'what happens when' post in the NEWBIES thread, telling you all about DQ stage? Look again.

    You are giving a good impression of someone who doesn't want to put the time in, nor appear at the local hearing, to win this one.

    Thanks for the super quick one. This is the thread I have followed and asked questions about, so I believe I have read up the correct thread, I just had a few questions. But in general I do agree with you that I am finding time difficult.

    Right so this 100% means that I would either need to attend or dial into the court hearing.

    The point is that actually I work on a day rate as I'm a contractor, and it would actually work out cheaper for me to work the day and just pay the ticket off early. This is my main motivator for asking these questions. I assume the courts aren't open on the weekends.

    My final and much more appropriate question then, how long do the average court cases take?

    Typically less than an hour, but best to be early and if they are running late then some waiting time too.

    Ah ok, not a whole day. I imagine I could do it in my lunch break and just cost me an hour or so.

    Thanks, I'll file for having it moved to my local court then.

    Definitely don't rely on just an hour away from work (and it won't be over lunchtime!)


    As advised in #49 you do need to consider the possibility of delays in getting started, though approx an hour is the time for the proceedungs
