Gladstones haven't replied to my emails at all, the LBC was sent on 4th July and I have heard nothing more.

Is it worth sending them or HX an email to ask if they intend to continue with this to court stage, giving them xx days to answer?

Thanks Pjr, it seems they are trying to get their act together, new (POFA compliant?) NTK's and new signage.

I sent an emial on Fri 21st Sept to Lisa Nandy, local MP for Wigan.

Received a letter from her today saying she is certainly happy to make representations on the keepers behalf.

Now I know the email has been read properly and it's not some auto reply because I sent it in my own name and didn't mention the keepers name at all, I included pictures of the NTK and Final Demand letters with her name on them.

The letter was sent addressed to the keeper with a consent form due to data protection, assuming because the email was in my name.

    Consent form signed and posted.

No idea what will come of it, but she will keep us fully informed of any progress.
  • The car park in question is owned by Kingsbury Tool and Jig Company 1998 Ltd., they don’t have planning permission to use the land as a car park and neither do HX Parking to erect signage and ANPR cameras. I submitted a freedom of information request to the council as I’m challenging a PCN on behalf of my wife issued in March 2018.

Nice info, thanks for that. Do you have a link to the FOI, if it's publicly available?

You can post a broken link, change the http to hxxp and/or remove the www.

That information would be great, I asked council who owned the land and was told it wasn't them and to ask land registry, I found that someone else had ask land registry and got this info dated 20th Sept 2018:

Registered Owner(s) : LICHFIELD MACHINE TOOLS 1990 LIMITED (Co. Regn. No.
1217291) of Coppice Side Industrial Estate, Brownhills,
    West Midlands, WS8 7ZZ.

I have the pdf from them, so any proof you could provide would be fantasic.

Finally got a reply from Rachel

    Good Afternoon,

In your original email, you requested images be cross referenced with entries on the list for the day before, the day of, and the day after the contravention - you have now requested something different. As you were advised in my previous email, this could not be provided as there was no way to see if an entry was incorrect or not as private vehicle registrations sometimes contain less digits than the standard 7 digit VRNs - this is not a case of 'smoke and mirrors' as you state.

The data is not incorrect, you failed to enter your full and exact vehicle registration which you have been advised in both your notice to keeper, and subsequent appeal decline. Entering '06' does not constitute a full and vaild vehicle registration which is required by the car park user as per the terms and conditions. The data streams do not contradict, your vehicle registration did not match what you entered into the pay and display machine therefore it is not inaccurate. We can not rectify an error made by the user of the pay and display machine when you have shown by your pay and display ticket that you did not enter your full and valid vehicle registration.

Cancelling PCNs with up to 2 digits error is an internal process, any incorrect entry is a breach and may result in a PCN being issued, we choose to allow for human error however do not have to on any case.
Our short privacy notice was on display, along with signage explaining both the terms and conditions, and that a breach of this would result in the issuing of a PCN.

As this is now with Gladstones, we will not be engaging in any further communications with youself directly and if you choose to complain further via the ICO, we will liaise with them, and them only.

    Regards

    Rachel
