If this is UB, UKPPO do have a contract but it is a UKPPO drafted one where Joey (joseph.eddison@urbanbubble.co.uk) signed it. See if UB can furnish a new one that says that UKPPO can take action in their own name.

There is also a termination clause (clause 8). So ask if the contract is still live.

So what you're saying is that technically Karen shouldn't be using her name, but should be using UKPPO as the claimant? If so, what would be the advantage of that in a situation like mine?

Again, thank you to everyone who's helped me so far!

(Also, after a quick google, it looks like Joey Eddison is no longer part of UB and now works for Realty Management Limited.)

It says see if UB can, not JE. Get proof of posting and include it in any bundle that you have taken steps to confirm the claims that UKPPO have made. If you don't ask, you don't get. Even a no-reply is worthwhile. Copy to UKPPO

Note: The reason is based on PD18 where it says
1.2 A Request should be concise and strictly confined to matters which are reasonably necessary and proportionate to enable the first party to prepare his own case or to understand the case he has to meet.

They may argue that PD18 is not appropriate to the SCC track but it will be for a judge to decide that and in any case, it is covered by CPR 1.1

    Hi everyone,

I've been working on a draft for my defense and will post shortly. At this moment in time, am I correct in thinking I just need to provide a witness statement? No skeleton argument as of yet?

Just out of curiosity on the AOS, I don't have to post evidence directly into the MCOL website do I? It's been 10 days since receiving the Claim Form, so I'm just making sure everything is being done correctly.

This really does become full time thing having to defend yourself when it gets to this stage.

    Thanks!

You need to re-read post #2 of the NEWBIES FAQ sticky thread.

There is a nice pictorial dropbox explanation on how to do the AoS.

You should also read Bargepole's step by step guidance on the process you are now going through - also linked from that same post.

In summary, you really do need to re-read post #2 of the NEWBIES FAQ thread. All the information you need is there. You need to refer to that before asking questions. It is actually quicker to do that rather that wait for an answer on your thread.

as above, you are letting yourself down by not studying that NEWBIES thread post #2 , honed by volunteers who have given up their free time to make it as up to date as possible

    in short

do the AOS asap, as you only have 14 days to do this and you have wasted 10

    draft your defence

post it on here for critique

nothing else to do at this stage, no evidence , no WS , no SA , just the defence , which will be emailed as a pdf attachment before day 28 after the service date on the MCOL, to the CCBC (after signing and dating it)

Defence and Witness Statement are two ENTIRELY different things
You never HAVE to do a skeleton argument, either

AS noted above, why on earth are you delaying the AOS? You dont get prizes for waiting.

    Evening all,

Tonight I completed the AOS, I had no idea what I was waiting for.

Having a little browse through my correspondence with Karen, attached is "one of the letters we send to you" - Karen does not state that this is the NTK. http://!!!!!!/ukppo100418

Please also see attached my first defence draft. It's very much information I've found through many different posts and forum examples of what applies to my case, based on the inability UKPPO have to know the identity of the driver, the lack of a compliant NTK and the PoC being half-baked. Of course I could be barking up the wrong tree with everything I've written so far, but all of your help is not going unnoticed.

Thanks to everybody for their patience with me so far.

    Bump for comments.

Please copy & paste the defence in a reply, Elmo111, in full, because some might not be able to, or be happy to, click on unknown links.
