Just bumping this to the top, I'm feeling this unnecessary pressure based on UKPPO's impeding deadline that they've given me - now 5 days.

Any help in composing a response to the last email from UKPPO is massively appreciated.

    Thank you.
    I wouldn't respond further.
    Wait for the Claim Form.
You are not going to convince them to do otherwise unless you cough up £600, and before you ask, no-one is suggesting you do that.

While waiting, of course you can begin to prepare yourself by re-reading post #2 of the NEWBIES FAQ sticky thread.

Refer them to part 5.2 of the pre-action Protocol:-

    https://www.justice.gov.uk/courts/procedure-rules/civil/pdf/protocols/pre-action-protocol-for-debt-claims.pdf

And request the proof of postings necessary for them to use the Interpretations Act.

Thanks for the reply Castle, when you say proof of postings - do you mean a receipt as such that they should have for each of the NTK's that they've sent out - as in possibly recorded delivery receipts?

In response to KiethP - is it wise that I stop fighting my ground having gone this far in already?

Proof of posting such as a, well, proof of posting that you get from a Post Office counter when you send something first class post from a Post Office counter. Recorded delivery, if not signed for, is proof of non delivery.

You have nothing to worry about unless this gets to court, but if that is the case, you should know that we have a 99% win rate with MSE assisted court cases.

Nobody here wants you to stop. In fact, everyone here will support you in whatever you decide, but know this, you can win.
    You should win.
    You must win.

What Keith is saying is, the ball is in your court and now you wait to see who blinks first. If they try court, you have a very, very good chance of winning with the full support of all the experts here.

You may want to contact the DVLA and find out when your data was accessed by UKPPO; it's possible they only asked for it once and then re-used it.

They are also known not to take or keep pics/paperwork.

You do know the legal department is run out of the back of a garage in Manchester.

If you are close, pop in and ask for the pics. Also UKPPO's owner's name is pronounced "cheat em"

Meanwhile, up the ante, get your MP involved.

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

Hospital car parks and residential complex tickets have been especially mentioned.

The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas.
You never know how far you can go until you go too far.

Thanks everyone again for all of your help and support - honestly this is a ridiculous amount of assistance you've given me so far! Overwhelming to say the least.

@Fruitcake, I e-mailed last night asking for the proofs requested, highlighting the use of the Interpretations Act - and also referring them to part 5.2 of the pre-action Protocol. I've had no communication from them today, which is the first day they've not replied other than on the weekend.

@Castle, I'll e-mail the DVLA and find out when the data was accessed.

    @IamEmanresu, That's a great idea, i'll pop in tomorrow.

@The Deep, Wow, I didn't know this whole 'industry' is so scandalous...getting a local MP involved is absolutely next level to show these parking fools that we're not standing down.

Again I cannot thank you enough for your advice so far, I hope you're all having a good week too!

    Afternoon everyone,

It looks like UKPPO have gone quiet with me after my last e-mail, so I thought I'd post a little update.

I'd requested each NTK of the 4 parking charges, and a picture of the signage terms, as the signage pictures they've sent me in their last correspondence are completely illegible.

I've also asked if they seek to bring claims under the Protection of Freedoms Act 2012 (Schedule 4) as suggested above by Coupon-Mad.

I referred UKPPO to 5.2 of the pre-action Protocol, and this seemingly where they have decided not to respond.

Today I've e-mailed the DVLA asking for information about when UKPPO have requested my information.

Brilliant. It would be interesting if you popped in to 'see' them to chase up a reply. Take someone with you, these companies are rough.
