    What store? What car park?

    Is it just the one store there, or more than one retailer?

    Smart do not own any car parks, and operate as parasites on real businesses.

  • B & M Friars Gate Doncaster, there is only that one store there. It has changed operator from smart to G24 back to Smart I believe & Smart currently operate it, in any case it is hem who supposedly sent PCN in January

    an update and request for help- so after initial defective LBC I drafted the previous responses to gladstones (rebuttal) and smart for DPA.

    I have a received a response from gladstones. I sent my letter via email in middle of February. I received a reply a few days ago. I have yet to receive a reply from Smart Parking from my DPA request but Gladstones have included all of their evidence.

    I'm not sure of what defence I can use. There photos suggest signage in place at the time stated 90 minutes or £90 charge. They took over the carpark in October 2017 when they operated a different system. I have found a newspaper article which states it was maximum 2 hour stay, first hour was free and had to get a ticket for second hour.

    The photos they provide of signage is taken when leaves are on the trees and all foliage is green, etc so must have been taken some months after the date they claim there was a parking contravention for which I am being billed. The evidence they provided suggests it was 90 minutes and the vehicle was parked for 2 hours 8 minutes.

    I called smart to ask for details of when different terms and conditions have been in place and what they have been and for details of when they changed to 90 minutes they advised they are different again now but they can't tell me when they change, etc and to email to request the info but stated they don't know if it will be provided.

    My other issue is that none of the photos of signage show a sign that clearly states rules have been changed.

    At the time of the alleged contravention I was the keeper of the vehicle. My husband and I were both insured to drive it. I no longer have the vehicle. As previously stated I have ADHD which means it is harded for my brain to read large volumes of text or to note small details within it so unless expressly stated on clear signage that changes have occurred had I been the driver I would not have known to reread signs or have understod that new rules were in force. Though of course I am unable to identify the driver at the time.

    Do I have any valid argument or is the overstay by whoever the driver was too great? It ia annoying as they repeatedly change time periods and rules to cause more contraventions. am I entitled to the information regarding changes by law to allow me to provide this as a defence? Can I insist?

    Sorry I have read all the threads but not sure if I have a leg to stand on as the keeper due to timings invovled
