It says DRP Reference which begins with a 4 then below our reference which begins with a 1. It then says letter before claim and says "we act on behalf on the claimant and we have now been instructed..."
It is also says Yours sincerely Gladstone Solicitors. The address at the bottom is from The Terrace, High Legh Park Gold Club in Knutsford.
At the very end it says please now contact our client's agent, DRP, in order to discuss a payment proposal... & gives what it says is DRP payment line phone number.
It is telling me I have 30 days to pay or reply.
I feel quite panicked0 -
Are there any financial information forms for you to fill in?0
-
does it include a reference to financial forms as well as the 30 days to reply ?
if so, you must treat it as an LBC and issue a LBC rebuttal, plus send an email to the DPO at SMART PARKING and get all the data they hold on you
I am still unsure of DRPL sent this, but do as I said and treat it as a LBC due to the reference starting with a 1 and due to giving you 30 days to reply, plus it has their golf club address too
so a SAR to SMART
and an LBC rebuttal to GLADRAGS, just in case it is a formal LBC0 -
It says says "if you believe you have a valid reason for non-payment , you are able to reply pursuant to Paragraph 4 of the Pre-Action Protocol for Debt claims under the Civil Procedures Rules 1988 ('the PAP'). A version of the Information Sheet and Reply Form, you must first create a login, for which you will require your reference (gives the figire starting with 1). Alternatively, you can request a paper version (see overleaf).
The bit that is most scaring me is that it says "our client is satisfied that it has sufficient evidence to support this claim and, if necessary, will rely on this evidence in Court.
Where do I find the templates to action the above?
Thanks so much for your help.0 -
Is there a way for me to private message you a couple of questions that directly relate to this? I am a rookie with forums so don't know the rules or how they work0
-
the NEWBIES FAQ sticky thread will help you with templates etc for this, as CM has collated the best info which is in that thread, so please go there
I do not help anyone privately on here, which is why my PM,s are turned off
life is too short to get personally involved, which is why most regulars wont help out privately, no matter what the issues are
this is a public forum , with public advice , and GLADRAGS are warning you about am impending possible court case bcause under the new legal rules of oct 2017, they have to do so
so what you must do is get all the data that SMART PARKING have on you, plus send the LBC rebuttal denying the alleged debt
this is a game you have been picked to play in, a legal game, and this juggernaut will continue regardless (unloess you paid that £170), which we DO NOT RECOMMEND
its pay or fight, we would tell you to fight, but as its a legal issue, its complicated, which is why we ALWAYS refer people to that newbies faq sticky thread, as all the answers are in there
BUT , bear in mind that this forum is NOT a legal aid forum, its a consumer help forum. it is not set up to help people to fight court claims, no matter if its about parking or not paying a plumber or decorator or builder, or landlord (all are small claims court issues)0 -

Gladstones have done this before ... giving 30 days to respond ?
When the letter is just another of gladstones pimped out letterhead.
But the letter asks for payment to DRP who are just an inert droid
I suggest that Gladstones are now abusing the PaP and the 30 days by pretending it is a real LBC.
If this was a real LBC (not with ref 4) Gladstones would be asking for direct payment and not paying the DRP moron0 -
Thanks all. I will try my chances in this game and hope that the odds fal in my favour.
I managed to find the newbies thread again and have found an SAR template.
I am struggling with the wordig for the bits that I am asking for. Does this cover it?
"Please supply the data about me that I am entitled to under data protection law relating to myself. I require that this include all photographs taken, all letters/emails sent and received, including any appeal correspondence.
All data held, all evidence that you will rely on, and a full copy of the PCN, NTK. I also require a list of all PCNs that you consider are outstanding against myself and/or this VRN, as any claim must be for all PCNs in one claim, not several separate claims."
Also the template gives this as a paragraph
"If you need any more data from me to confirm my identity please let me know as soon as possible. It may be helpful for you to know that data protection law requires you to respond to a request for data within one calendar month."
Do I leave this as it is, as if they take a calendar month to send it me I will be outside of gladstones time window...
Sorry I am not very good with these things.0 -
PS red x sorry I wasn't trying to be cheeky in asking to ask you a couple of questions just didn't want to give them a way of identifying me by asking publicly0

seems ok to me, but ideally add a scanned copy of the front of your V5C (log book) if it has the correct VRM, name and address on it, and dont add that confirming identity paragraph, due to you attaching that data to the initial emailed SAR request, as an attachment , but definitely add the one month warning , even if it fails their timescales
ps:- I dont agree with beamer on this occasion as gladrags appear to have ticked all the LoC boxes (30 days notice, financial forms link , reference starting with a 1 , golf club address etc) - so send them a generic LoC rebuttal0
