I am currently on a DMP with CCCS they have been making monthly payments to NEXT for the past year without missing a single payment.
Today I received a letter from Moorcroft saying that they were acting on behalf of their client the letter stated the following:-
This is a notice of INTENDED LITIGATION before legal proceedings in the County are issued. We believe that this letter fulfills this requirement even if its not actually read by you.
To prevent our recommending to our client that solicitors commence legal proceedings, it is essential that you settle this debt without delay. Payment should be submitted in full in the next 7 days to the value of £200.
Both our client and we don not wish to take this action but if agreement cannot be reached by 26/04/11 a claim may be issued by solicitors instructed to act on behalf of our client without further notice.
WWe would draw your attention that if Judgement and an order for repayment in full is obtained and remains unpaid, a range of court enforcement options are available to our client and an application for one of these may be considered
We would emphasise that should Judgement be entered against you this may affect any future credit application you may make elsewhere. We would also draw your attention that all legal costs incurred are usually payable by the debtor.
Please contact us today as we will be happy to discuss a repayment programme that you can afford and maintain. All payments must be made payable to "Moorcroft Debt Recovery Ltd" and forwarded with this letter to the above address

Panic has hit me as I have never had legal letters like this before and I am worried about this.
I would like some help as I am worried sick about this letter totally ruined my holiday weekend
1. I contacted NEXT 8 weeks ago to dispute the amount owed as CCCS had paid more than NEXT had deducted from the account but they have not responded. How does this affect this letter of INTENDED LITIGATION
2. Should NEXT not have notified me that they were passing the debt on to MOORCROFT ?
3. How is the Data Protection Act applied surely NEXT cannot just hand my data over to a third party without my consent ?
4. Should I request a copy of the CCA although I do not think they will have a signed one as it was done online ?
5. I cannot pay will this end in court?
6. What Should I do next?
7. Does anyone have a template of a letter i can use to respond to this letter?
I have contacted MOORCROFT this morning by phone to seek advice on what happenings next and advised them that I was on a DMP with CCCS but the lady on the phone was a bit vague. I told her I could not pay anymore than what is being paid via CCCS and that CCCS has my authority to deal with my financial affairs. She again just said ok. I asked her why this was being sent and she replied they were acting on behalf of NEXT.
I also informed her that I had written agreement from NEXT accepting my DMP payments for the next 3 months until July 2011 again vague.
Can anyone offer me advice to stop my worrying and answer the questions I have raised I would also welcome any other advice given on this company and matter.Mikon Riding the DMP Rollercoaster full of ups and downs but i will get to the end. :T:j

You might be better opening a new thread where some experienced peeps can help but from my point of view and what I have picked up on here its just words and nothing more tp scare you into paying. You are with CCCS and they will have checked what you can and cant pay so if they are stupid enough to take it further then the judge will likely just agree for you to keep paying what you do now. Ring CCCS on Tuesday and Im sure they will be able to offer advice and assurance in the meantime please calm as it is merely a pathtic attempt to scare you xx

I will do my damndest to pull that back a few months on the way. hit the nail on the head MIT! My problem is that if I "overdo" the debtbusting it ends in a blow out of massive proportions! Instead I try the treats occasionaly way of thinking which then sometimes leads to overdoing the treats under some ridiculous justification for x,y or z! Problem for me is that I dont care passionately enough about not paying "them" interest! Must get my act togeather though!
Have managed to put all cc money onto low lob or 0% which is good but need now to pay off! Other problem for me is the loans finish in 4 years and I know I could then pay the cc off in a matter of months when those payments go so that also dampens my enthusiasm! I am getting there though as try not to spend on unecessaries but can resist anything but temptation!!!

NSD's are a no no for me unfortunately. I need to give kids money daily more or less so cannot take part in that one. I've joined the 100 day challenge. Going to try and finish off ARGOS once and for all and also overpay one of my CC's by the >£300 I put on it recently during one of my splurges

ISOM I really do care how much interest I am paying as all my debt is on interest bearing cards etc as I have run out of options as far as low interest or 0% is concerned and I keep thinkin that the £200 per month I am paying could take the kids and I away for 2 weeks to Spain or something and I am just throwing it away basically. Sorry been so remiss! Been busy with work and feeling exhausted so have had bloods done to see if physical reason...think Ive probably been overdoing it a bit as have been out and about and need to get a bit more me time balance into the equation. Feeling better about money and really want to get rid of my od and start with the cards before interest kicks in next year! Problem with 0% is it lulls you into a false sence of security! So back on the wagon i am. ive pleanty of crafty projects on the go so no need to shop! Main areas at the moment are sandwiches for work so going to try and be organised! Also get back to more batch cooking etc...

Hi Everyone
I hope you are all doing well. I had a bit (major) wobbly moment today, but I'm blaming it on hormones. I'm just sick of struggling and fighting to stay afloat. No doubt I will be back too my usual bolshy fighting self tomorrow, but today I'm going to wallow in being fed up.
Tomorrow I will re-look at my budget and see how I can get rid of this devil of a debt as soon as possible.
