  • Just a quick update on my case got back from holiday to a letter from the court stating the claimant had failed to pay the hearing fee on time and that the claim was struck out.
    Are they like to re apply for another date or is that the end of it? letter says the case on xxxx 2019 to be vacated.

    Do they have that many cases that they forget to pay the fee or was it just a case of calling my bluff to see if I would actually go to court?

    Who knows the workings of the Gladstones minds ???

    They are totally incompetent as they have proved to you

    If they do start again, doubtful, then it's a new case to expose their scam with the help of this forum

    Have you considered claiming against the PPC who have no doubt wasted your time (and money)?

    Why nor send them and invoice and when/if the ignore, a letter before action.

    you then have up to six years in which to take further action, (or not).
    You never know how far you can go until you go too far.
  • Even though I did not go to court I would just like to thank everyone who has helped me from the start as without all the questions I had answered i do not think I would have taken it this far on my own so I am extremely grateful for all your help and massive patience with a novice like myself.

    It's not uncommon. They seem to like to leave people dangling, especially when their case is weak

    Received a letter today to say case is to be reinstated and to forward all unavailable dates to the court, can I include all the days I’m working? As I have no annual leave left and will have to take unpaid leave.

    Really, maybe they are desperate.

    It was because of their failure that the case was struck out and the court knows it. I find it odd that the court asks when you are not available rather than when you are available ?

    You have used all your holiday time so I guess it will be the next available day when your 2020 holiday season starts again.

    Reading between the lines, the court is in no rush to hear the case and is inviting you to tell them when you will be available.
    You must tell the court you have now used up holiday leave until next year .... see what they say

    You cannot bow down to the whims of the incompetent Gladstones
  • I rung the court today and they said case was reinstated due to ‘administrative error’ but didn’t say if that was down to the court or Gladstone’s.
    They asked me to give dates of anything planned like holidays or dates I cannot attend court but added would be unlikely to be this year anyway so not to worry.
    With work and Christmas holidays booked I am going to say unavailable until January at earliest, better dig all my evidence back out again then.

    Yes, and give yourself a good week to get back into work after the New Year break, so say you are only available from, say, w/c 13th Jan, or whatever you are comfortable with.
