    So short of throwing the printer out the window I managed to eventually get it to print so all good and sent it around midnight got an automated reply as you said so io check my account online Monday.

    So I have had an email back from the court saying that they are unable to open my attachments as they are in a unrecognisable format? As far as I can see they are in pdf can’t see why that would happen? I have replied with a large screenshot of them as I am unable to get to my computer until tonight and asked if this will be ok will wait to hear back but not sure what I’m gonna do if not.

    yeah phoned them Monday afternoon guy said my defence had been filed so guess they either accepted my screen shots or they managed to open pdf? received a letter this morning confirming it all as well so all good.

    Received a letter from Gladstones today stating intention to proceed with claim, they have requested a paper hearing in the belief that the claim is straight forward but from what I have read that is pretty normal?
    They have sent a copy of their questionnaire completed yet I have not received one yet seems odd they have received, completed and sent me a copy before I have even had one arrive.

    All the above is contained in the NEWBIES FAQ sticky, post #2 and how to deal with the various components.

    Sorry, but we can’t keep pace with typing out a full detailed response every time this is raised (numerous times a week), hence the inclusion in the sticky, for 24/7/365 reference.

    Almost all you need know about the entire court process, from LBC to the actual hearing (if it takes place) is detailed in that part of the sticky.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    You can either wait for yours to arrive from the court or download one, complete it and submit it. Solicitors try this on in an attempt to frighten the poor old punter into giving up or paying. when you get your DQ (download or from CCBC) just say NO to mediation and NO to "on papers." See this posted by Bargepole: -
    4. After sending off your Defence, the Northampton Business centre will send a copy to the Claimant, and then send a Directions Questionnaire (form N180) to both Claimant and Defendant. You must complete this by the date given, and send it back to Northampton, with a copy to the other side (or their solicitors if they've nominated one as the address for service). The recommended answers to the questions are as follows:
    • A1 = NO to mediation (they want the whole amount, you want to pay them nothing, so no scope for mediation. This will not go against you)
    • B = fill in all the details, name, address, etc
    • C1 = YES to small claims track – this is the limited costs track for claims up to £10,000 in value
    • D1 = name of your local County Court – unless you are a Ltd company, the case files will be transferred there
    • D2 = NO to expert evidence (this relates to medical negligence cases and suchlike)
    • D3 = 1 witness (that’s you) (or more if you are going to get another person to provide a statement)
    • D4 = Put down the dates of any pre-booked holidays, NO to interpreter (unless you need one).
    Note: Gladstones are currently including a 'request for special directions' asking the Court to hear the case on the papers only, without an oral hearing. You should oppose this, and include the following text in D1: “The Defendant opposes the Claimant’s request for special directions, and requests that the case be listed for an oral hearing at the defendant’s home court, pursuant to CPR 26.2A(3)”.

    Not odd at all and you should not have been surprised.

    Read again item 7 on the list in post #66 above.
    Here it is again:
    Do not be surprised to receive a copy of the Claimant's Directions Questionnaire, they are just trying to put you under pressure.
    And item 8 on that list tells you that you can download your own DQ, which is just what the Claimant has done.

    Yeah fair point just got worried I’d missed something and posted before looking again.
    I know it must look like I have not read newbies thread but I have gone over it loads over last few months and gone through previous posts on my thread just sometimes have a bit of mind block with all the posts I have been reading, and getting married in 6 weeks time so heads all over the place at moment trying to get stuff done and paid in time.
    Will try remember to read before I post next time.
