Why do posters refer to the DJ Taylor decision that they CAN'T prove with evidence and ignore the DJ Grand one that they can?2.7 I believe the £60 added by debt collection agency to be an abuse of process I refer to case heard by District Judge Taylor in Southampton court on 10th June 2019 Claim number F0DP201T.
The Claimant's particulars disclose no legal basis for the sum claimed and it is the my position that the poorly pleaded claim discloses no cause of action and no liability in law for any sum at all. The Claimant's vexatious conduct from the outset has been intimidating, misleading and indeed mendacious in terms of the added costs alleged.
This is why I posted what I did in Beamerguy's thread about Abuse of Process, giving everyone a link to DJ Grand's decision and some wording to use that provides evidence for why the added costs are fake.
Do you know what? I don't care about DJ Taylor's later (duplicate) decision, in fact it's annoying me no end, because it's taking everyone here off on a tangent they can't prove, and they then ignore the IOW judgment, the BETTER one that gives them a piece of evidence that they CAN use.

Good spot thank you, going to print of my evidence tonight and hand deliver to court Thursday, can I email Gladstone’s the WS and attach pics of evidence? Saves me printing off 3 copies of everything and relying on Royal Mail.
Also deadline is Friday and not had Gladstone’s WS yet is it normal for them to leave it to last min?0 -
Yes, hand deliver to court and e-mail is fine for Gladstones, who will try anything to put off the defendants by, for example, sending the WS as late as possible.0

You need to take to court a copy of your SENT ITEMS showing it was sent and when. GS have before now lied to court and said it wasnt sent.0 -

If they do not acknowledge receipt of my email is a screenshot of sent item ok? i could post but printer will need more ink so won't be able to post till Thursday and that might be too late.0 -
You could show it to the Judge on your smartphone, tablet or laptop. Whether he/she will accept that will be their decision.
