    I'm being deadly serious. Like I said they have insurance to cover this very event so why wouldn't you put a worthwhile claim in?

    Because generally courts won't entertain claims for emotional distress or inconvenience except in certain types of contracts (where the subject matter of the contract is to provide peace, relaxation, enjoyment etc) and even then, it is always a trivial sum in comparison to the actual degree of distress/inconvenience suffered.

    For example a couple couldnt live in the house they had purchased for 2 years and had to travel extensively to oversee work (that shouldnt have been required in the first place) every single weekend and their marriage even broke down due to the strain caused by it. They were awarded £750 - the equivalent of approx £1 per day.

    Also, any claim for "psychological pain" would require an actual psychological/psychiatric injury.
