    Are you referring to the notice of intended prosecution?

    A lbcca would come from the creditor, though it's doubtful that this is one (did you get one previously?)

    I have had the exact same thing happen to me with Excel!
    I still had my ticket and produced it for them and the appeals company also told me I needed to pay despite my argument that their machine should not have issued me with a ticket that only had a single letter and it couldn't possibly be a legal parking ticket even though I had paid. I have decided now with the help from the forum to not pay. It's an absolute scam and ridiculous that they should take my money for parking and then want me to pay a fine in addition! It's been such an upsetting ride and I only expect it will get worse now that I will be ignoring their letters. Good luck to you! Has it gone any further yet?

    I'm at court on Monday for the same car park. Just doing final prepping on various stated cases and the Equality Act.
    I was in there a couple of weeks ago taking more signage pictures to prove that the picture they've sent me and the court isn't of any of the actual signs in the car park (even if they were good enough to pass the Beavis test which they're not!). The image they sent has the missing word included. An old guy was trying to get a ticket, he'd been into the hotel and checked in and thought he'd better get a ticket before the wardens came. "Erm you only have 10mins from entering," I told him. He'd been there about 20. He didn't have enough coins and asked me if he could use a card. I told him about the RingGo facility so he brought out his Nokia 3310 and proceeded to try. "Pardon," he said to the automated response "...oh er AB12C.... oh dear, it's gone off!" He tried again and in the end, I gave him £2 and told him to move his car to the Council's multi-storey ASAP and come to this forum if he gets a PCN!
    Proof once more that their signs can't, in any way, claim to be sufficient to form a contract with the driver!

    I really do feel sorry for the older generation who are generally technologically deprived and computer illiterate. How on earth do they deal successfully with the !!!!!! they are bombarded with by the PPCs and their scum agents, other than to stump up to make it all go away?

    It's just an appalling, inhuman predicament for them.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    I've just had my day in court - just over a year since the first notification from Excel; failure to convince the IAS and many letters/threats from debt recovery agents. We did not have legal representation, just stuff picked up online. Our defence was that we made all reasonable endeavours to comply with the contractual terms - why would the machine dispense a ticket of the wrong format if the system already had our plate number to check against (also no 2 digit plates in the UK). The Judge (rather quickly) found in our favour - he seemed particularly interested that Excel could not explain what loss they'd incurred! Now for a letter to my MP!
