  • No. It's the attitude of people who think they can do what they want and get away with it. If you know that you have to pay to park somewhere and you choose to ignore that, it is your fault. If you don't want to pay to park, don't park.

    Again, the OP was asking for legal advice, and not about rules that some people make up. If you cannot see the difference between the two then you shouldn't be posting here.

    If you can also post where I stated any opinion on the rights or wrongs of this then please point them out to me.

  • I disagree - how are they sharks? The land belongs to Asda presumably and if they choose to charge people to park there it's up to them.

    There may be any number of reasons that they impose a parking fee, without knowing the location of the store, it's difficult to tell, but chances are it's in a town centre, where free parking attracts loads of drivers who are not even shopping in Asda.

    As long as the notices are prominent, anyone who chooses to ignore them does so at their own risk. It's likely that on any number of occasions, the OP and others have parked for a few minutes and escaped the traffic warden, but this time they were unlucky - it's tough, but as they say, them's the breaks!


    I am following this with interest as Asda by my house has just introduced fines for incorrect parking in parent/disabled bays. I have been told that usually the car park doesn't actually belong to Asda and is the responsibility of an outside firm, who are usually the owners. I believe this is why there is no liability for damaged cars etc when you park them there.

    Please don't shout at me (this topic seems heated) it's just information I got from someone who worked at Asda, when I mentioned someone parking in a parents bay without children.

    I hope the OP gets this sorted specifically if it is only an invoice and incorrectly issued. I think people learn from their mistakes and I'm sure there will always be some change in the car from now on. I think all of us would be angry about getting a fine.

    After all we could say similiar things about bank charges and it being people's fault for being overdrawn etc, but I'm sure many people on here have claimed their money back. It is not in dispute that the lady was at fault but the legality of the ticket/fine seems now to be the issue.

    incidently our local iceland has a pound charge and you get that back when you shop. Im in there for a max of 5 mins sometimes less but i still pay the charge to avoid that dreaded ticket

    £1 charge for reading any of my posts, £50 fine if you fail to pay. This rule applies to everyone, including you. I'll pass it on to a debt collecting agency, regardless of whether i could actually legally fine you or not.

    I think the people were being abusive. They were also implying that a RULE is infact LAW.

    That is highly inaccurate and has the potential to have serious financial implications for others. That should be dealt with by the mods here, due to the implications for people who come on here for advice.

    As the person obviously doesn't care, I await in anticipation for the next vitriolic attack on someone who has the nerve to disagree with them, or asks them to back up a statement that is obviously incorrect and ill-thought out. They were, after all, stating that a rule is infact Law.

    I dont think anyone is implying that the RULE is the LAW, I at least cant find a post that says this. I think what we are trying saying is the RULE should be the LAW. That the RULE is completely justifiable, meaning there is a reason why the Supermarket have introduced a RULE, for which the fee is refundable anyway, but the main fact that the OP ignored this RULE justifies why there should be a fine for the ignorance, at least in the interest of those that have chosen to pay the refundable fee.

    Let's go further back though and identify the reason why it is justifiable and why the supermarket has introduced it. If it's the same reason as any other i've heard then it is to stop people parking there for free but not using the shop. Now if the fine, as you say, is justifiable by virtue of the reason for the charges existing, the since the OP's wife was using the shop and thus, not breaking rule number 1 (the golden fleece of all rules) then she should be outwith it as the rule was only set up to catch out those who are parking for free and not using the shop.
    In any event what we're seeing is a breach of contract, there is an implied contract that by parking there you will pay the £1 fee. When a contract is broken the law seeks to(where possible) put the parties in the position they would have been in, had the contractual obligations actually been performed, I believe that's £1 to ASDA.
