  • its like going to a shop, knowing you have to pay for something, and deliberately choosing not to! because u know u pay for parking and choose to ignore it. would you ignore the cash registers too?!

    Why didn't your wife take the 'parking ticket' to customer services in Asda and show them the receipt for her shopping? I would write to Asda to explain the situation and see what happens, they may act reasonably and waive the ticket - send them a copy of the ticket and the receipt. She could say that she was collecting some urgent medication from the pharmacy - think of anything plausable to say to try and get them to change their minds.

    The machines they have on some Asda carparks are terrible because they do not give change and be b*ggad if I am going to shove £2 in there for half an hour or whatever.

    It's an invoice, not a fine. They will have to take you to County Court if they want to recover the money. Which they will not do.

    Have a look at the parking fines forums on https://www.pepipoo.com.

    Ignore the ticket. Wait for the reminder letter (they will get the RK details from the DVLA). The RK can then write back, telling them to take the matter up with the driver. The RK is NOT responsible for payment of the invoice and is not under any obligation to tell them who the driver was.

    Simple as that, really.

    Just don't let them bully you into paying. They will tell you all kinds of lies - they will tell you it's a fine or a penalty (it is neither - it is an invoice), they will tell you the RK is responsible for payment (wrong - only the driver - who may be the RK of course - could possibly have agreed to enter into the contract, but their damages are limited to what they have lost - nil if you purchased a ticket, the price of the ticket if you didn't), they will tell you that it will affect your credit rating (wrong - they will need to issue Court proceedings, get a judgment, and then you would have to fail to pay that judgment - it won't even go as far as Court proceedings).

    They are sharks; please, please, please don't be intimidated by them.

    Also, tell the debt recovery company the debt is in dispute (no need to say why), and they will have to refer it back to the parking company.

    I disagree - how are they sharks? The land belongs to Asda presumably and if they choose to charge people to park there it's up to them.

    There may be any number of reasons that they impose a parking fee, without knowing the location of the store, it's difficult to tell, but chances are it's in a town centre, where free parking attracts loads of drivers who are not even shopping in Asda.

    As long as the notices are prominent, anyone who chooses to ignore them does so at their own risk. It's likely that on any number of occasions, the OP and others have parked for a few minutes and escaped the traffic warden, but this time they were unlucky - it's tough, but as they say, them's the breaks!

    I have sympathy for simiont here.

    I think the description of sharks is directed to the parking company or the debt collectors.

    the law is very clear here and is very different from parking fines given out by the police or councils.

    The description of sharks is not unfair as all evidence shows that a lot of the private parking companies lie about liability, credit rating being affected and county court judgements being inevitable,None of which is true.

    This is bullying tactics and I would not expect anyone on a website which intends to be about consumer revenge would agree with companies lying and bullying people to extort money would they?.

    I would though,like for the law to be changed to allow the police to impose a penalty fine on drivers who park in any disabled bay whether public or private without a blue badge.

    Consultant31 - if these companies were honest, they would not resort to the bullying tactics and telling the downright lies that they do. THAT is what I consider to be contemptible; not Asda charging its customers £1. I think my post is pretty clear on that point.

    And the OP WAS NOT caught out by a traffic warden, but an employee of Asda's agent, who simply put an invoice on the vehicle.

    The law says that the company would be entitled to, at most, damages limited to their losses, which is the cost of a ticket - £1.

    Anyone who thinks the OP should pay up and shut up obviously has more money than sense. Please all send me your addresses, so that I can invoice you for reading this post.
