  • Hello again folks. Would welcome a little extra help on next steps. A "Formal Demand" has now been received from UK CPM. (is this a NTK?)

    Anyway... am at point of going to IPC website and beginning appeal (as this is the next step as suggested in sticky.)

    Just checking.... that this should be the next step, but there is a question...

    (i) CPM has sent this letter with 2 images of vehicle in question within this demand.
    Neither clearly show any reg plate of the vehicle, and so neither could be used to identify said vehicle and hence, as sole evidence of any infraction.

    (ii) Also the vehicle in question is clearly shown parked 99 % within the parked bay, but with one wheel slightly turned and slightly over a line, and an edge of a bumper slightly over a line. This is clearly a case of over zealousness, the vehicle is for all intents and purposes within a bay, and someone here imagines that "De minimis" would apply, i.e. that any court would consider any "contract" for all intents and purposes fulfilled, and throw it out.

    So.... question is, should these two points be mentioned in any appeal? or stick to the template?

    Any thoughts welcomed. will be off line soon for a bit, so be kind... if someone doesn't immediately respond to any kind advice but rest assured, your help is very much appreciated.

    UK CPM state...
    ...on the PCN itslef that appeals should be "in writing"
    ....On their website they say:
    All appeals must be made in writing and sent to:
    Appeals Department
    UK CPM
    PO Box 3114
    Lancing
    BN15 5BR

    And on their Final Demand they say:
    "All enquiries must be in writing"

    No email or online appeal option is offered.... but on their normal contact page there is an email address.

    Wise to send to their email address?? (that IS "in writing" and would give me a record of sending) but would not be sent "to their postal address."

    or to write long hand to their postal address?

    or both??

    Thoughts welcomed please. (Have hunted for other threads that cover this, honest)

    While I believe email would meet the requirement, personally I prefer to use the post. That forces them to respond by post too, and avoids any risk of emails getting redirected incorrectly as spam.
    If you do use that route, send it first class and get (free) proof of postage from the PO counter. It's then considered legally served the next day.
