So I've lodged the appeal through the website. As I understand it I'll get a rejection by email and then they'll continue to send me letters through the post for the next 6 years but I need to ignore these unless they are from a court?

I took a screenshot of the appeal being received - will this be sufficient for evidence for me to save?

You shouldn't ignore a lbcca (which comes prior to Court correspondence,)

The FAQ thread advises on how to deal with a lbcca

  • Thanks very much for the responses.

I've had a few reads of the sticky but it's a lot to take in and tricky to pick out the bits I need without having to double check here.

Thanks for the link pappa golf - I'll keep an eye on that thread and that'll be useful for me to see what their next move might be.
  • Received this response today:

We refer to correspondence received from you concerning the above numbered Charge Notice.

Please note that the responsibility for this Charge lies with the driver of your vehicle at the time the contravention was observed. However, it appears from what you have stated in your appeal that you were not the driver on the date in question.

In order for us to process your appeal correctly, please follow the instructions below.

    1. Notify the driver of the vehicle that they will need to appeal to us directly including their FULL NAME and a valid FULL SERVICEABLE ADDRESS within 14 days.

    2. If you are representing the driver we require a signed and dated statement from the driver of the vehicle confirming that you are authorised to appeal on his/her behalf: this needs to be an original signature and not a photocopy or stamp. The statement MUST contain the drivers FULL NAME and a valid FULL SERVICEABLE ADDRESS.

Please ensure that correspondence is submitted through the portal (portal address here - can't post links) in order to adhere with the appeals process.

    OR

    3. Pay the PCN. Standard blurb about the date being extended to pay the £60 and not the £100.

So - my question is, after reading this thread from today

Parking Appeal - Driver information requested
    Posted by Gazilion

Should I use a similar reply to the one the poster there made

There will be no admissions as to who was driving and no assumptions can be drawn. Your Notice to Keeper is not compliant with Schedule 4 of the Protection of Freedoms Act 2012. Additionally, since you have clearly stated that you are not relying on POFA, you thus cannot pursue me as the keeper. You must therefore cancel the charge, or offer me a POPLA code.

    Yours faithfully,

And hope the charge is dropped as quickly as theirs was?

All advice greatly appreciated as always.

No, that response is not appropriate for IPC companies because PoPLA isn't available.

Also have they "clearly stated that they are not relying on POFA"?

I would suggest you follow the guidance offered in post #2 by Redx - ignore until you get either a Letter Before Claim or court papers.
  • OK, thanks very much Keith. All the acronyms spin my head a bit!

OK, thanks very much Keith. All the acronyms spin my head a bit!

The main ones we use on the forum are contained in the NEWBIES FAQ sticky, post #5 - separate section covering acronyms.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • Hello again.

I have another email/letter from the Vehicle Control Services saying my appeal has been rejected.

They say I now have two options
    1. Pay the CN
    2. Appeal to the Independent Appeals Services (IAS): If you believe this decision is incorrect, you are entitled to appeal to the IAS.

Do I lodge an appeal with IAS or am I ignoring this as it's not a LBCCA?

Many thanks for your help as always.

    ignore .....

as quoted you may .... may ... may get a LBCCA ... but I very much doubt it ...

try doing a forum search with JLA to see how many people have been where you are ......

there is a fighting fund set up for the first time that they VCS decide on court .... it would have to be a big court ... what with will all the interest that would be shown ....

while not directly linked to JLA ... try watching the MP's debating private parking ...

  • Thanks very much for the reassurance Ralph-y.

Do you have a link to the fighting fund so I can contribute please?
