VCS can issue charges if Excel authorise them and (as nosferatu1001 says) as long as the signs say VCS (not Excel) offer the parking contract. Often, Excel and VCS get this wrong at various sites, including Albert Street and others.
You won't get to see the contract between Excel & VCS until court evidence stage but you don't need it because they could create one in minutes, being sister firms. The signs are key and the name on any P&D ticket spewed out by the machine if it's that type of car park. Remind us which car park this is?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I have sent several letters to Excel asking for this information. All I have received is a letter saying how disappointed they are that we have not reached an amicable agreement. No information or reasons why it's not available. Surely if they have the evidence then they should send it irrespective of the IPC requirements. I don't believe a word that they say.
The appeals process at Excel/VCS is run by a team of minimum wage office workers with no legal knowledge or experience whatsoever" From Parking (Code of Practice) Bill (First sitting) Hansard.
There was a recent case on here of the PPC not having the landowner's permission or not evidencing it and it was thrown out virtually straight away. Not sure who the PPC was. Wish I could remember the case.

And you've concentrated on who they are targeting but can't see anywhere what they claim the driver has done? What did the NTK say? What do the particulars say? The LBC was not responded to (wasn't sure what to do as described in post 29 above).
The driver is alleged to have "parked without payment of the parking tariff for the vehicle registration mark of the vehicle on site".
The NTK is the generic one sent by VCS with non-compliant POFA words attempting to hold the keeper liable on the assumption they were the driver.
No particulars received yet.

As you didn't pay for a P&D ticket for that car park you will not know the name on the P&D ticket. It would most likely be Excel. You might want to go there and get one to prove it for any claim that comes.
If there is mention of VCS it is too small to see as the average person (including a judge who will adopt that mantle) would conclude the contract is with Excel. The signs say Excel; the P&D ticket most likely says Excel; and if you check who pays the rates, it will be Excel.

All that extensive small print dotted all over the place, worse than a HP Agreement. How on earth is anyone expected to read, let alone assimilate it (and its consequences) before the simple act of parking a car?
Outrageously consumer unfriendly.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
