  • Hi!

    I've received a " Letter Before Claim" with a financial statement and reply form. Earlier in the year I received "Notice of intended court proceedings" letters and followed the advice given to User: Adbe and sent of Daniel San's letter. Now that i've received this letter should I request the information again i.e re-send the Daniel San's letter or one of the others? Thanks

    Read up on this in the newbies faq thread #2 which covers court claims from receipt of the lbcca right through to the hearing


    There is specific advice there on your rebuttal of the lbcca and near templates to use for your defence

  • With every rebuttal that I send they seem to offer me a little bit more information. They have claimed that there are no further pictures to offer just the entry and exit images sent with the original charge; because they are members of the IPC they have to evidence they have authority to operate at site concerned; they are not pursing the RK as the driver but are pursuing the RK on reasonable assumption (I know that there is no such assumption), they have broken down the figure with details of estimated interest and court fees. They have addressed the matter of the signs although they have not provided the exact details requested.

    Would it be okay to request;

    a copy of the monitoring system records held on your database; of the ANPR camera and the Pay & Display machine showing the synchronized data that this letter before claim correlates to.

    Or stick to the templates requesting the same information again? Feeling anxious should I say so?

    I guess I may need to do this again once this is passed on to their solicitors:(

    I wouldn't bother replying again. Others may think differently.

    Just make a note of all the things they have failed to supply and use that in any court case that may materialise.

    Wait patiently for a County Court Claim Form to arrive.

    If Excel sent that, they won't be passing it to solicitors, they will issue a claim themselves. And we still beat them 99% of the time!

    Good afternoon all, I'm still in fight mode and made a complaint to whom I thought was the landowner recently. They informed me they are not the landowner and that the PPC's sister company has a lease contract. If the land is owned by Excel can vcs issue charges on their behalf? Is there anyway of establishing which ppc holds the contract for the car park? Thank you for any direction with this, I've searched online and have not found anything that can help so far.
