leeks refusing to refund me please help

Hi

Can anybody please help me on where i stand regarding consumer rights please.

I bought a sofa set from leekes store in coventry on 6th/Dec/2017

it was a closind down sale and it was a ex display/end of line sofs set.

i paid £2000 for it

i was told that the leather on the sofa was the best and it was called full analine, it will last for ages. (it was a quick sell as everyone was all over the place) after the sales person said it will last for a very long time i went for it.

i was told (and it had a ticket on it ) that the price was originally £5000 (this was false as it was about £3500

nobody mentioned that it was non refundable (there were no signs anywhere)

the delivery date was set for 14/dec/2017

I did the dreaded thing i shouldnt have and i payed in cash.

i seen different sofas i like and asked a different sales person (different department) if i can get a refund on the first set and purchase the other one i just saw, to which he replied "shouldnt be a problem if its still in the store.

I left the store, thinking il get back before the 14th.


a couple of days later after reading about full analine, and realizing the sofas might not fit in the front door, i ring Leekes (before the 5th day ends) and explain, the lady told me the sofas are still in coventry, the store is closed for some reasone today but go down tomorrow and it should be fine as they are still in coventry.

i went to the store today and the manager was addamant he was not going to refund the sofas,

I explained to him about being mis-led about full analine and being mis-sold a sofa.

He said only head office can help you.

He checked the system and it said the sofa set is still in Coventry. he then went into the ware house and said they have been sent to cardiff. so you will have to speak to sharon in cardiff.

head office customer service heard my story about the full analine miss- led sales tac tic and that they wont fit in my door, but they did not care. they were actually very very rude and at the end they pretended they cant here me, talked among themselves and then hung up.

both the store and the head office are saying they will not refund the sofas.

at the point of sale i was not warned about the non refundable purchase verbaly or with any notices ( the lady at the head office was saying there were signs in the shop, i told here "No there were not and also that i cant see any now as we speak as i was in the store)

so can any body give me clarity on where i stand as i have no knowledge of sales of goods act and things like this.

If i can get any advise before the 14th Dec 2017 delivery date,that might just save me.

    If you bought in store there is no automatic right to a refund. They don't have to tell you as thats the base line. You weren't told it WAS refundable, so you were not misled.

    its good to find things out from others appart from Leekes, as it just felt like they are lying when they told me these sort of things

    the sofas are actually quiet good looking and as a last reort i will welcome them in the house (some way or another) but i just want to check all my options

    when you write "If you bought in store there is no automatic right to a refund" does this apply to all
    ex display ?
    end of line ?
    closing down sale ?
    or all three ?

    will i not be covered by any sales of goods act ?

    It applies to everything sold in a physical store, whether new, display, end of line, closing down. It makes no difference, the sales of goods act was replaced in 2015 by the consumer rights act, of course you will be protected but that protection is for items that fail to conform to contract not for change of mind.

    There is no automatic change of mind return with a purchase bought in-store, regardless of ex display, end of line etc etc.

    The automatic right to return for a refund is not for in-store purchases, unless the store allows it.

    The Sale of Goods Act has been superseded.

    i thought everyone has 14 days to return things,(sorry i dont know much about these things) but doesnt everyone get 14 days and if they dont like the item get a refund ?

    i changed my mind, because, like a similar situation to a previous lady on the mse forum i was mis led into thinking full analine was something different to what it is. dont get me wrong i wont mind keeping the item, i just want to know how the system works,

    and yes if anyone else does find a way please do let me know,

    No, that has never been part of the law even before it was replaced in 2015. You only get that with distance sales (mail order, over the phone or online) because you don’t have the opportunity to inspect the items before buying. As you were in the store you got to physically check everything you needed to so there is no need to give you a “cooling off period”.

    Most retailers in the U.K. go above and beyond and do allow returns for change of mind but that is down to individual stores whether to offer it, how long to allow and what T&Cs are attached to the policy but it is not an automatic right.
