    I was told before by the hotel that they are unable to cancel it as it has been so long and will break the agreement the hotel has with PE.

    What about when you complained to the Manager? Then the Head Office of the Hotel Chain?

    You need to get this cancelled by the Hotel, sharpish.

    I contacted the hotel and they have tried to cancel the charge. They received a response which they forwarded to me saying that due to the fact it has gone to POPLA and costs have been incurred by PE they will not cancel the charge.

    I am lost at what to do now.

    It is not a penalty, it is an invoice for the damage you have caused them for breaching your contract with them. Damage which a judge is likely to consider de minimus

    As a gesture of goodwill refer them to Arkell v Pressdram.
    You never know how far you can go until you go too far.

    It is NOT a penalty charge. If they used those words (which I doubt) then it is not saved by Beavis.

    They are starting to wobble, probably because they realise they will lose in court (if properly defended.)

    Write back to PE with a drop hands offer. It has cost you X amount of time and money to defend this. Tell them that you will get £95 in costs from them at court when you win so it is in their interest to drop this now and incur no more costs.

    Be forceful, and state you have the might of MSE behind you, and you know you will win in court.

    What did your MP say?

    Do you have friends or family who can leave negative feedback on the hotel's Fakebook page, and add further negative feedback on Trapadvisor?

    A suggestion would be pay the £60 then send a LBC to the Hotel Head Office, and sue them for it back.

    Alternatively, send the LBC now stating that you need this money to pay the scammers because of the hotel's nincompooptiveness.
