The alarm bells do ring for me tbh . it would be very difficult to make a dress to order for £30. Even at minimum wage the time it takes to make the dress simply wouldn't be worth it.

Then there's the whole sale, you have to wholesale for around half retail, this needs a huge mass production factory, similar to the Chinese factories.

The T&C's are also definitely wrong, standard sizes and colours picked from a drop down box are not personalised and not exempt from statutory law. If everything is made to order, why even bother with those sizes in the first place?

Thats a good catch - I didn't even look at pricing but no way is an experienced seamstress making made to measure quality dresses from scratch for £30.
You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride
  • I hadn't looked at prices and was hoping to give the site owner some slack, but clearly she isn't ready to be lawful or honest. The prices are quite literally a nail in the coffin to any hope of proving a 'bespoke or tailored' offering.

I still don't accept her answer for my DFS type "it's gone in a second if you don't buy it" advert. Thankfully I have a screenshot and will submit it to the ASA.

Say it whichever way you feel, but you are NOT exempt a change of mind under CCR with the items you are describing.

It's admirable, to some extent, that you are replying to comments here, but, that doesn't mean you can select parts of legislation that suit you.

If I were you, I would take the advice given by your part-time weekend legal advisor and seek proper help.

I think I may just click through to ASA. This isn't my gripe but the fact I followed a few links and was given the "only 8 seconds left to buy" message is not good. Particularly when the items are still there a few minutes later. Oh dear.

I navigated your site for a 2-3 minute period, no more. I had the message on the second item I viewed.

But you don't offer either made to measure or tailor made. You offer a drop down size selection.

What is more, the last option on your sizing is a "made to measure" choice. Which then gives NO further way to give measurements.

What bit of this don't you understand?

One thing I will say is, this is one of the biggest websites in the UK and you've been given an opportunity (not least because you should have MSE approval to post on behalf of a company) to put things right. If it were me, I would be getting my ship in order and watching the traffic flow in the right direction.....I suspect no one has reported your posts as we all want the same outcome and don't want this thread to disappear forever.

    Hi All

I started this thread because I wanted to ask for advice from others in the know if my understanding was correct and have been very grateful for your replies

People are still arguing with her for the drop down standard size menu, but I think she explained in a previous post that the code is being rewritten. Maybe if you select size 10 then have to input 10 more measurements that might be enough to make it be classed as made to measure and therefore exempt from the change of mind returns

I will wait to see what changes are made to the ordering system

I do think that Gabriella has been brave posting her comments and coming back to update, and I'm grateful for that

The majority of her site is unlawful. You came here for advice, if you want to purchase from her, then go ahead. But when your purchase isn't quite what you expected, or your consumer rights aren't honoured, then you might forgive everyone for not wasting time on giving you advice. Why ask if you are going to ignore the very good advice given?

The site isn't lawful, not even remotely so.

That's a bit harsh. I am not intending to buy from her site. I asked whether my understanding was correct

I acknowledged that, in my opinion, it was brave of her to come on to defend herself and try to justify her decisions

I have occasionally thought the same .
You are on a guilt trip and she can’t justify her errors.
I think she’s been badly advised( I’ll give her the benefit of the doubt which I don’t often do)

I suspect she has a strong feeling , or is being told to ignore naysayers, but she’s already been cut an AWFUL lot of slack here simply because she’s responded but ultimately she’ll be judged on whether she’s made her site lawful or not.

Other people who get no response from her will now find this thread-I don’t think she fully realises the implications of that
