Hi. It won’t let me post links to my letter0

Thanks redx that looks spot on! And to confirm I should remove clause 13 from my version? Surely I should have some grace period too as it’s a similar argument?0
-
if the grace period argument fits your facts , keep it in
I was referring to the 2 facts that they have failed the law named pofa2012 and that they have already obtained keepers details, so that is a historic fact now , so that template differs in those 2 facts from the CM standard template (although either will do, but mine addresses the points you made which are very common issues on here)
if they also failed grace periods too, its another point so leave it in if they have failed on clause #13 of the BPA CoP0 -
Hi redx the time in and out is an extra 20mins.however, I spent 5-10mins; finding a space to park, sorting out daughter once parked then spent quite a bit of time on the new parking machine which I couldn’t get to work properly (I normally use this car park but they changed it to a new system). So from the time i entered was 1524hrs but eventually got a a ticket at 1534hrs. This is not seen or considered. Then again when leaving a few mins to sort out daughter and eventually leave car park. My ticket time was from 1534hrs-1734hrs and they clocked me leaving at 1744hrs (so admittedly 10mins over run?) which I believe is within the grace period?0

I thought the leaving grace period was to cover the time taken from being ready to leave the parking space to actually leaving the car park?
So, without wishing to put a downer on your argument, time taken 'sorting your daughter out' is not something that the car park operator needs to take account of.
The leaving grace time is to cover such things as queuing to leave, avoiding manoeuvring vehicles, avoiding pedestrians and the like.
The grace period should not be seen as a ten minute extra bonus.
Just my opinion.0 -

It is, but like Keith says, don't talk about sorting your daughter out.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

sometimes TMI (can be detrimental)
if the driver was allowed over 10 minutes to leave a car park, then if this particular driver took 10 minutes to leave , that is fine and within one part of clause #13 of the BPA CoP
as for the initial grace period, this is unpsecified in the CoP but a PPC should reveal it when asked , typically we assume this period to be 5 to 10 minutes
if a ticket was bought and paid for , then no "bilking" occurred , so there was no intention to defraud and so the driver made every effort to comply with the signage and the BPA CoP
it is the PPC`s job to prove their case, so if you believe they failed on grace periods , leave the clause #13 paragraph in the initial appeal
if in doubt , include it anyway
but dont "milk it"
and certainly dont put all that guff into any initial appeal, keep it short and sweet
the K.I.S.S. principle0 -
Many thanks all0
