NCP ANPR Parking Fine

Hi. Apologies I am a newbie and confused other all the abbreviations, terminaology and what to do?

Basically today I received a fine “Parking Charge Notice to Keeper” from NCP for a breach of of the car park terms and conditions of use: “Parked longer than the time paid for and liability for the same having been brought to the attention of the driver by clear signage in and around the site (Ipswich cox lane) at the time of parking. The breach relating to the period of parking was recorded by an approved ANPR camera.”

It has an entry time of 1523hrs and departed time of 1744hrs. Pls note the ticket paid for time was from 1534hrs to 1734hrs. BUT ANPR surely doesn’t show or prove my “parked” time?? So I am confused as to why have ticket machine (btw new systems in place and I literally took 10mins trying to get a ticket with my vehicle reg) if ANPR times will surely always differ?

My main question is, as by some advice on the internet, should I just ignore this letter or should I appeal it? If appeal then What template should I use? I am lost with the overwhelming info/stickies?

I have noticed it also says “YOU ARE INVITED TO:”
1. Pay the unpaid parking charge; or
2. Basically notify them of the driver in writing

    The info is clear, use the BPA version template. Don't reply if they send a fishing reply asking who was driving. Don't add your own words to the template in case you put 'my parking time' or anything daft like that! No need to add to it.

    Please don't copy the BPA template appeal here and ask 'is it this one?'.

    Was the postal PCN received within 14 days of the parking event?
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    Hi. The offence was on 21/10 and date of sending letter is apparently 03/11 but I received it today 08/11.

    In Which thread is the template?

    ANPR times are TIME ON SITE , not parking time

    grace periods are outlined in clause #13 of the BPA CoP (oct 2015 edition)
    please download it and read it using a pdf reader

    these charges are enforceable, in court , if a judge decided in NCP`s favour

    until a judge decides , not one penny is owed

    but do not assume it cannot be enforced, there are many reasons why it may be able to be enforced

    it is near the top of this very forum, free advice , you wont get better advice anywhere else , not even if you paid for it

    ps:- if they failed to adhere to the law (POFA2012), then its easier for a keeper to get it revoked , so no blabbing about who was driving
  • Many thanks for the replies. I am looking at the stickie and found the template. BUT this 14 days and PoFA thing I am confused about. Do I need to modify the template in some way and state I received the parking charge after the 14 days?

    If the NTK arrives provably late, this does not make the PCN 'void' but it means there is 'no keeper liability' possible.

    If they are a firm which alleges 'keeper liability' under the POFA 2012 (which they don't have to) the a postal PCN has to arrive by day 14 if there was no windscreen ticket, and between day 29 and day 57 if there was a windscreen ticket. Some firms (e.g. Civil Enforcement, Highview, CP Plus, Smart Parking and some small PPCs) don't even bother with POFA 2012 wording so the keeper is not liable if you point that out to POPLA. So you can see why the keeper is the person identified in your appeal.

    Just send the blue template as it is.
    No change or adjustment necessary.
    As advised in the first reply on this thread.

    All that other stuff you mention can be expounded upon at the POPLA appeal stage if necessary.

    Just sending the forum template is often enough to send the PPC elsewhere for easier money.
  • Can you post a copy of the letter as this seems to be a new thing for NCP to use ANPR. If it’s anytbing like what our support group is seeing on Facebook this is going to become a big issue in the coming weeks.
    If you were not the driver write to the parking firm and tell them who was so they CANNOT hold you liable. The person who was driving the car is responsible so let them deal with it. Not you! Don’t let people with an agenda tell you otherwise.
