Lost Court Order due to no reply

Hi,

I've read the pinned post, and I can't find anything specific to a lost court order. How do I go about an already lost court order due to no reply? Can I appeal?

After moving house last year, we have a lot of mail still being sent to our old house.

The car that received a parking fine was in my sister's name, who now lives abroad. All of her mail is still sent to the old house.

I have recently received a court order for £250 payment to Gladstone Solicitors for SIP Parking.

I really need some help as to how to go about addressing the issue. The land had poor signage at night, and no machine was in sight.

Can anybody go about giving some advice? Thanks in advance.

the person whose name is on the court order would need to pay £255 for a set aside , then defend the original court claim

put £255 set aside into the drop down forum search box and google search to read more about it

ps:- post #2 of the pinned post NEWBIES FAQ READ THIS has set aside information listed

pps:- if the court order is not in your name , its nothing to do with YOU

If you mean you have a ccj by default registered against you then search here and on google to learn about "set aside".

(If you decide to go for this then don't delay)

It's not clear who has been sent the £250 bill.
    You or your sister?

The court claim is against my sister. However, she no longer lives in the UK, the car however is still in her name.

Do you think I should bother fighting it, or should I go ahead with the set-aside?

YOU cannot do anything , YOU cannot start a setaside going , you are you and your sister is your sister

when was the CCJ applied for and when did she leave the country?

She left the country 2 years before the CCJ. It wasn't her that got the ticket, but because the car is in her name it's been issued against her.

Write back to the sender saying the addressee no longer lives there.

It would also be a good idea to update the Registered Keeper's particulars with the DVLA.
Up to a £1000 fine for not doing so.
