Thankyou for your advice. I had a closer look at the letters and in VERY small writing at the bottom is states 'Hamptons Legal is a trading style of Lowell Financial Ltd.' I don't know why I didn't notice before but I guess I wasn't looking.
I have sent the second letter (the 12+2 one) recorded delivery to both Lowell and Hamptons.
I have also made a telephone appointment with CCCS on your advice (I have tried the CAB but it is a long wait for an appointment) to see if they can help me fight this at all or at least help me know what I am doing.
I will let you know what happens next.

Edit: Actually I'd start the process now - they have committed an offence so all the non-compliance letter is doing is asking for repayment of any monies paid and the default removed but as the offence has now been committed I'd report them now.

Sorry to hijack this thread, I found it as someone linked to the letter template... however, I'm at the first stage of challanging a debt from paypal... and have come up with this... does this seem okay?:

I do not acknowledge any debt to your company or your clients.
Please provide me with a copy of a signed credit agreement with Paypal (under Section 77(1) and Section 78(1) of the Consumer Credit Act 1974) and a true signed copy of the Deed of Assignment.
For me to owe a company money I would have needed to have borrowed it from them and to do this you would have needed to sign a credit agreement.
You have 7 days to respond to this matter.

Can anyone advise me on what a CCA should look like? My partner's Barclay Loan was transferred to a debt collectors, Debt Managers Ltd based in Edinburgh. They sent back a statement of payments and default charges. (he lost his job due to illness and was not covered by any insurance as it is a pre existing condition) So there are three pages of payments and charges and the last part of the document they sent to us is a Staff Barclayloan terms and conditions, with 14 terms and conditions. It does not mention that it is a credit agreement or mention the CCA 1974 (I think this is right), it says the current rate of interest is 6.2%. There is no signature or date on this document. I can scan and upload if necessary but can anyone tell me if this sounds like it is enforcable(sp?)? If this is the case that it is not legally enforcable can anyone point me towards a letter to say that it is not and he won't pay, if our circumstances were different we would try but he is in receipt of benefits.

What MERCER'S have provided certainly does not seem like a true signed copy of the original cca.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
