Right, but it might not state a DATE. Might say 'not later than 14 days before...'

If not, it's on the front then, read every word. You've got it there, read it carefully.

OK so does it give a provisional hearing date, and when is that?

I am pleased the court has told CEL that if they fail to proceed/pay the fee, they will be liable for your costs (remember that, and start putting a costs schedule together - you know how, from the Newbies thread).

It says the hearing of the claim will take place at 10:00am on the 26th April 2018

So, because this date comes first:

unless the claimant does by 4.00pm on the 29th March 2018

There are two dropout points. The first is when they have to pay the hearing fee (29th March) and the second is when they have to book a legal rep/rent a mouth which is 7 days before a hearing.

If they revert to type you'll get a discontinuance around the 29th March

If they don't discontinue before, you must file your WS and your documents by 12 April (14 days before the hearing date).
Sometimes CEL don't discontinue until later, so you MUST be ready.


I think wait until the 29th March, crossing your fingers they don't pay the hearing fee. But if you hear nothing then get on with your WS.


In the meantime, to avoid a complete panic, spend the next two and a half months keeping abreast of this forum, reading threads and specifically CEL threads, so that when you come to draft your WS you understand everything better and are ready.


If you take AndySab's advice (which I fully endorse) you will start work on your WS sooner, so that there is no last minute panic.


Never assume that CEL will discontinue (but be comforted by the fact that if you put up a robust fight they are extremely likely to).
