It's too late to use THEIR appeals process now? (14 days)
    No it isn't!

You have at least 21 days to appeal, usually 28. Get on with it, this is easy.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

The original templates are still there.

If you found something different, you were reading the wrong thread.

'Hi Nemron. I, too, have received a Parking Charge Notice from APCOA more than 15 days after the alleged incident occurred at Luton Airport so I spoke with the Compliance Manager at the BPA.

He stated that the 14 day limit only applies to PCNs issued under the Protection of Freedoms Act 2012. My PCN makes no mention of that Act so reading the Notice further one must assume that it was issued for 'breach of contract'.'

I have no idea whether the PCN was issued under this act or not. I mean my gut says they are issuing it under something else like the guy above says; breach of contract. But here is where newbies with hardly any time to spare like me could come a cropper. I can't be sure. Mainly because I don't understand it all fully. I want to take this all the way and win, but I'm a little nervous. Someone needs to pay guys like you as a full time job!:A

Exactly! Where are these templates?!? I found them a few weeks ago but now I'm annoyed that I can't find them!!
  • If your car wa "broken down", a common occurrence with both private and local authority tickets, the simple approach is to write to the operator (with proof of posting) and give them the details.

However your definition of "broken down" must be a genuine one and be supported with evidence of the type of issue. It's called "frustration of contract"

Similarly as "broken down" cars are a common feature on car parks the signs there must have some sort of instruction on how a motorist should deal with this common eventuality. This is often a "help" line which the unfortunate driver can call to let the operator know.

So what was the problem with the car and what did the signs say and what did you do about informing the operator about your problem?

The car had a faulty fuel pump (unknown to the driver at the time). Initially, GEM motor assist were called to the car at another location, but they were cancelled when the car started again and the car was driven on way to owner's house. HOwever, Half way between these two points is where the car cut out on a busy dual carriageway- luckily at the entrance to a car park. A sign was left in the front window that the car was immobilised for the time being. It was moved later in the day to a garage where it STILL is. The garage and GEM motor assist can corroborate this.

The driver had to catch a bus and did not look at the sign. The driver is looking into whether or not a sign was actually there at the time.

The driver did not contact the operator. That would have been a very good (though I would assume fruitless) idea. But they will live and learn.

Um... It's now been 30 days. I am useless. A busy, tired, double transplant recipient father of three working full time type of useless; but this procrastination is down to fear. NOthing else. I'm still going to try though coupon-mad.
