Private firms RENTING land

HI everyone
I recently received a Charge Notice through the post from NEW GENERATION PARKING MANAGEMENT. THe car had broken down in a Tesco Car Park and overstayed the 2 hour welcome.
I'm planning to appeal (somehow- I have no bloody clue) but then..
I spoke to the deputy manager at the Tescos who said that they were NOT the landlord. They rented the building from a landlord. Furthermore they were unhappy as they were losing custom.
LIkewise, New Generation were RENTING the car park from the same landlord. Are they allowed to charge us under contract law if they are not acting on behalf of the landlord??
Just to be clear, New GEneration are renting land, and charging me £100 because my car was broken down on the land they do not own...
Any advice?

Edit your post to remove information about who broke down. Only ever refer to The Driver and The Keeper. Parking scammers monitor these fora and revealing the identity of the driver is not advised except in specific circumstances.

NGP usually infest the Cardiff area, but I think I’ve seen Gloucestershire cases maybe? Dealing with so many cases does tend to fog (sounds something like ‘fog’!) accurate memory! :rotfl:Please note, we are not a legal advice forum. Is this a major Tesco outlet, or one of those small ‘Express’ versions. Are there any other retailers on site and sharing the car park?

Express version with other retailers on site. It's perfectly plausible that Tesco are renting.
It's not a pay and display car park, but could the car parking company not make money from a rented site? When I went to the shop today to speak to the manager a man was outside taking photographs of cars before the security guard challenged him.0 -
the PPC will be acting for either a landowner or a Managing Agent , they wont be "renting" the land at all (very few rent or own the land)
the Land Registry will tell you who owns it etc , for a few quid
so NGPM will be acting on behalf of the landowner or M.A.
they make their money by targeting the customers of the shops etc
their money comes in from the pcn,s that are paid

I would beg to differ and say that its a retail park where tesco is one of many retailers on the site0 -
I am new to this, and yea I've read the newbies post which is so scary I think I may have to cancel Christmas and pay them the £100 they want.
I don't expect anyone to have the time to fight battles that I can't, but I am seriously confused, and it appears you guys have much more knowledge on the subject.
They are an IPC member and their kangaroo-court overseers IAS I now quote from the newbies thread:
The 'IAS' offered by IPC companies is considered far worse than POPLA.
It is named and shamed on forum posts regularly as a 'kangaroo court' because even a strong appeal loses in almost every case. The IAS favours the parking firms and expects a mountain of evidence from the appellant. Do not use mitigating circumstances.
I can't even use the mitigating circumstances of the car literally breaking down. The car is STILL in the ******** garage after being towed away!!0 -

Also, yes, sorry I did say it was a Tesco car park. But you are right: It is a small retail park. They, I m guessing, will be the land owners?0
