HELP NEEDED! Received County Court Claim Mail Sent to Wrong Address

  • I guess I would also need to add that I have since been to the site in point 8 also if I'm making reference to the signage in question.

    I will add this to point 8: 'It is important to note here that the defendant has since visited the car park in question to assess the validity and effectiveness of the signage in place.'

    I think it would be better to make the point about visiting the car park as a leading paragraph then all the other points on signage as sub paras to it
  • Thank you CM. I'll be sure to add that in. The Small claims defence against gladstones on the newbies thread was a huge help.

    Lamilad, if you think it would make a notable difference I'm all for making any adjustments, although I can appreciate if it isn't necessary then its not worth your time.

    It wouldn't make a huge difference it would just sharpen it up a little. I would def ensure the point about visiting the car park is made before/ leading up to the first time in the defence where you mention signage

    I agree with lamilad, a keeper needs to explain in a reasonable and clear way, how they know about the signs.

  • Understood. Would it not be better to leave it out altogether mentioning the signage or do you think it strengthens my defence.

    I thought that It might be a good idea to also mention the worn out bay markings as well (presuming I've visited the site in question). The paint has worn out and the markings are only found on the four corners of the bay as opposed to all the way around it which should surely work in my favor.

    What?! [Cough],[splutter] No! Signage is the very means by which they claim they have formed a contract with the driver.

    Without adequate signage there can be no contract... No contract = no claim.

    So of course you attack signage... In the strongest possible terms.
  • Hi, it's been around a month since I posted my defence to the court. I haven't recieved anything from the court apart from a letter stating acknowledgment of receipt of my defence. I haven't heard anything from Gladstones either. It does say on the letter that the claimant must contact the court within 28 days after recieving a copy of my defence but I haven't heard or recieved anything. Is this standard procedure? Or should I have been informed of whether the claimant wishes to proceed by now?

    The claimant should file and serve their intention to proceed with the case, but while they file it, they don't always serve it... Ring the court Monday to ask if they've received it.

    The next correspondence you receive will be the DQ.
