If you just want a refund of the flight costs then a chargeback or s75 claim would achieve that. A request for a refund doesn't need to specify the method.

That said, if the card holder is travelling in the group (with four other people) then S75 would likely apply to the whole transaction.

Hi can anybody help... I can't cry anymore tears! we paid for 5 flights on a credit card and it was a scam (the travel company cancelled the flights and didn't tell us) and we try to claim the money back can the credit card company off to only pay the card holders flight or not? 5 flights were bought under one transaction, thank you to anybody that helps

I think that you made the mistake of telephoning the credit card company and speaking to a poorly-trained salesperson. Try writing to them.
  • We booked the flights in oct to which they cancelled them Dec which we didn't know, we went on to check our seats july with one month to go do it was panic time. Virgin confirmed we definitely had no flights booked. Asked for a refund from dream world travel n heard nothing. Went to credit card who refunded us to enable us to book more flights. We come home from the holiday and they are saying they will only honour my dads flight and they are putting the £5000 back onto the credit card within 5 days! I don't have that money?
  • Forgot to say we sent all documentation to the credit card company too

You open a formal written complaint to the CC and escalate to the FOS if they don't pay up after 8 weeks or deadlock letter received.

I think that the credit card company is just "trying it on". In fact you are in a strong position: the only way they could make you pay is by taking you to court, and I cannot believe that a judge would find in their favour.

And yes: you should certainly raise a complaint with them and be prepared to use the Ombudsman service.

I don't know if I'm being completely dense but I don't understand. You say that the credit card company refunded the money paid for the original tickets which enabled you to buy new tickets. You then went on the holiday as planned. So why do you think that you shouldn't have to pay for the tickets that you did use?
  • We paid for original flights which were scammed on the credit card, they then refunded us that money as it was a scam to book secure flights, so we rebooked flights with the money the credit card refunded for the scammed flights. They are now asking for £5000 for the original flights? Does that make sense? So I will end up paying for two flights yet only used one as the other was a scam
  • The credit card company are only liable for my dads flight. That is the end of it they say! So me my husband and son are left with £3000 debt with no idea of how to pay it and no for scammed flights! They said go to the ombudsman but he won't do much so go to legal advice! What with money I don't have and already £3000 in debt

When you were refunded, the card issuer would have told you that the refund will be pending further investigation. All you can do now is make a complaint with the card issuer.
