Hi Bartgirl - I have always lurked on your diary and its good to hear from you, sorry things have been so tough for you and your son though and I hope that your Aunt is on the road to recovery.
Anyways, the N39 tomorrow, please do not worry yourself about it. You must attend as I'm sure you are aware but it will be conducted by a court officer, not a judge and they will go through a booklet of questions with you under oath, take whatever documents you have to photocopy and you will get chance to check over everything before you sign it. If you dont understand any of the questions or they are going to fast just ask them to stop - they wont be trying to catch you out or anything like it - it is purely to gather information which will then be sent onto the claimants.
This is the booklet that they will complete and it shouldnt take too long to do.
Hope you see this before you go x x xPay Debt by Xmas 16 - 0/12000

It seems there is a difference between refusing to give the information and failing to do so. Did they not give you any time to get prepared?

Hi Bart Girl
Sorry to hear you have had it so rough with your aunty. You must have felt so helpless. I have to say though does she not have any children to look after her, why is it that you are doing all the running around?
Still I hope that now things are on the up. Do you still have your job? Or did they make you redundant? I hope you still have it.
How is DS now? Has GFN been having access visits or has he not bothered?
Don't worry too much about the court, just do your best to provide what you can. For bank statements remember you can print them off y our online banking, so that will show them your income and outgoings through the account.
I too am a bit surprised that a debt from 6 years ago has gone to court. Have you admitted the debt is yours in that 6 years? Ie made a payment? If not then I question whether it is enforceable.
Good Luck with it all anyway.

Hi Bartgirl, so sorry that you have nad a rough time and i hope things start to get better for you.
I will be thinking about you and hope it goes ok at court.0 -
Thanks everyone for your kind words of support.
I was up until late last night then up early - not much sleep - worried about court this morning.
The court lady was very nice - I was a gibbering wreck basically.
They went thru all my paperwork and I made an offer of what I can afford and left it at that.
She said she should not really say so but the company who are pursuing me are a nasty piece of work ..
Shall reply to all your q'S tomorrow..am tired and ready for bed

If you have amde no payment towards a debt for 6 years or acknowledged it in writing, then the debt may be statute barred. The exceptions are if there was a court judgement stating that payment had to be made or if the debt was to the local authority - tax etc.
Hopefully you're a bit calmer now and are able to relax a bit. Glad you had one of the nicer clerks at your meeting. After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91

I have decided to scramble back onto the MSE bandwagon..
I went thru RyianAir and have booked 7 days away for DS and I in a months time. To the tune of £180 incl bags, taxes etc..cant wait!
I went to somerfield and use a coupon for £5 off a £30 spend. I am pleased cos altho its not a great supermarket i did get quite a few deals, and popped into Lidl for the rest costing me £37 for the rest of the month. I treated myself to stuff like J20 drinks etc and loadsa snacks that i'd usually not buy cos GFN would devour them overnight. Ice-cream, Pringles etc
At the moment I am desperate for a pair of Riding Boots. Silly me - I know! But all the pairs I truly lurve are abouy £90-100
Have seen a pair in Debs that I may get online. My 'budget' for them though is £50 and the pair I'd like i could get for from Debs for£ 70 using codes etc. Although TKMaxx may have a few - shall try there tomorrow morning cos they had a few but not in my size :-(
I am also after a new pair of jeans but am waiting to use the New Look Voucher from this website so i can get 20% off..
I am still conscious of the fact that I need to put something towards my hols etc so have devoted myself to Ebaying this month. I have told myslef that I should have something listed on there every sinlge day of Nov. I would like to make £100 but £50 would be amazing! I listed a handful of things a week ago and only made a tenner. But thats OK cos I have soldiered on and have another handful of items on there. Am pretty excited cos yesterday I had 17 watchers and today I have 22 in total. I had a BIN which went for £3. Bids end on Sunday so shall keep u all posted! So far - I only have bids on 4 items - but if they sell for what they've bid so far then I'd get £14. I remain hopeful !!
BGs back on track!! :T
