Used car from dealer fault advice please!

    You aren't really answering the question, The OP can say it over and over but if the dealer sticks by the stance stated in the first post what in practical terms do they do?





    1) Leave the car and walk away with no money or car and proceed to start court action?


    2) Take the car and start court action?


    3) refuse to leave the premises until refund given? Which could perhaps lead to other issues

    Ok then looking at the worst case scenario and the dealer refuses to take it back.

    The OP rejects the car and leaves it there and starts court proceedings to enforce his rights.

    Has the OP got the means to purchase another vehicle to use in the mean time?

    We'll await his reply to that.



    Thank you, Exactly my point, Knowing your rights are one thing, getting them enforced is a different thing entirely, and given the response already from the dealer I don't think it will be simple, Hopefully for the OP sake it is but they need to be prepared and willing for a fight

    Just because the dealer doesn't know the proper procedure doesn't necessarily mean he will not toe the line when Trading Standards have reminded him.

    You are basically telling the OP that it's too hard to enforce the law. Read your posts. He should definitely attempt to enforce the law intinitally by telling the dealer that he rejects the car under the terms of said law. If the dealer refuses next step is CAB to get trading standards involved. He doesn't have to go to a lawyer straight away. Any time along this journey he can decide to cave in. You aren't even helping the OP try and fight it, therefore you are telling him to cave.

    Your meant to stop using the car once you reject it.



    I really don't know. But no-one is really giving practical advice as to the real life situation.

    No, Your the expert it seems, im asking you practically what to do in the situation. Im saying they need to be prepared to take it the whole way, standing in a showroom stating your rights over and over MAY not be enough


    So he walks away from the dealer with no car or money tomorrow morning? and go to CAB?
  • The company i am dealing with is a big company. I bought a used car from one of the big car maufacturers so when i speak to the area manager tomorrow they should be fair... i hope

    I am going to say i reject the car stating the reasons above and i will let you all know how i get on.

    So ill ask again, OP takes his car down on Monday and the dealer sticks by the original stated stance, What does the OP do?

    From my point of view i don't really know!! What i am going to do is ring the area manager tomorrow (I'm in work tomorrow and unable to get down to the dealer until late), state the faults, my concerns, i dont want a repair and request a refund quoting the consumer act 2015.

    If the area manager refuses to give me a refund or a definitive answer on the phone I am very lucky that above my office at my work are where trading standards are located in my area. So i will be asking them for advice.

    When i do speak to the area manager i don't want to come across as being abusive and quoting acts, trading standards because i know some managers will take that the wrong way and might make my situation harder.

    Also i just went on live chat with the dealer now and they told me i have to speak to the area manager tomorrow and all that. But my purpose of this is i know have a transcript of our conversations.

    Don't let the dealer scare you into keeping the car as I imagine their tactics may be.
    Stay in control of the situation and don't rely on doing things verbally.
