parking eye county court letter HELP

  • no its not near the hospital. its in the main centre of Watford town in Hertfordshire. The address i was going to was Wilmington Close. this is basically a huge tower block of flats on the ring road. the ground floor level is let to some businesses. for example there is a dentist and an estate agent. The whole area there is impossible to park in. the address parking eye have used is The Xchange watford.

    Not sure if that link works? I zoomed in on the PE signs to take a look.

    The signs say 'pick up and drop off area' but anything else is illegible, and the 'area' is undefined. I think we need to work into your defence that you were merely dropping off medicine for a patient - but is that true?

    There is also no hint there that ANPR cameras are timing your arrival and leaving time, as opposed to actually allowing you 15 minutes parking time to drop something off (and the flats have several floors!).

    Will have a think about how to word this...

  • no I wasn't dropping off medicine. I work in the community and a call was received in the morning when I was in my office at the hospital. It was a distressed husband worried about his wife. due to the language barrier I could gauge what was going in so I decided to drive straight there and assess the situation.as it happens I did administer medication but didn't know that would be the case until I got there.

    Do you have a copy of what you said in the appeal you mentioned you made, and did they ask for more evidence but you were unable to divulge any more info?

  • I wrote a short letter stating the facts. I did offer to provide proof of my work registration and that I was working that day. I also said I could evidence that iwas doing an urgent house visit. no personal info was given other than my name and address. their response was simply I was unsuccessful.

    OK, that's good, so they didn't even ask for evidence and just rejected it.

    Is the exact time shown 28 minutes from driving in to driving out? Were you in the same spot when parked or did you pull over at the side then drive into a space once you'd phoned the patient to check it was OK/the right place?

    yes 28 minutes exactly.
    I pulled in with the engine running to call the patient. I initially got no reply. I then turned the engine off and went over to a man standing with a fluorescent jacket on (I presumed initially he was a parking attendant) to ask if I could stop there. he said yes if I was quick.i then went back to my car again to re call the patient. this time they answered so I asked them where I could park. obviously with a language barrier it wasn't an easy conversation but I was told it was ok to park where i was. I then moved my car forward a couple of spaces and park to go into the flat.
    annoyingly I timed myself and was really please I was back down to the car within 15 mins. I didn't realise I was monitored by a camera.

    Those sentences will go into your witness statement in due course. Both very good points to show your actual stopping time in the space was under 15 minutes and nothing in the signs suggested the time was not based on waiting time, as a driver would reasonably expect.

    Anyway, give us a chance to chew over that defence; when was the claim dated and when did you do the AOS, remind me?

    You have done the Acknowledgement of Service (AOS) of this claim, on MCOL, to extend your time to defend?

    Can you show the POPLA evidence pack, did you keep a copy or not? The evidence PE provided to POPLA online.
