on the 3.12.16 i was issued a ticket for parking in a 15 minute bay for 28minutes(£100 or £60 if paid within 14 days)- Yes there was a sign stating the time allowance. I was at work that day as a community nurse and was called to an urgent home visit. there is no parking at all in the area. i stopped in the bay outside the block of flats and called the patient. i was told by them it was ok to park there for a short time. i then quickly went to do the visit. as i was in my car making the phone call etc it ended up being 28 minutes. I wasnt sure what to do but ended up writing a letter stating the above and also offering to provide proof of patient and work info etc. Of course that was rejected! i appealed through the POPLA process again being rejected.
Unsure what to do and not willing to pay the extortionate amount i (probably foolishly!) ignored it.
Today i arrive home to a letter headed 'claim form. county court business centre'. court address is Northampton.ive never seen a court letter so no idea if its real or not! it gives me an option of paying:£100 amount claimed, £25 court fee, £50 legal representive= £175 total.
the attached letter gives options of:paying now/agreeing buy asking for time to pay/admit only part of claim/counterclaiming. there is also another sheet wanting me to fill in all my personal info-D.O.B/phone number/dependants/employer details/bank account saving amounts/incomings/expenses/debts.
WHAT SHOULD I DO??????

please read post #2 of the NEWBIES FAQ sticky thread near the top of this forum
then acknowledge it online and start preparing a defence over the next couple of weeks
ps:- if its from the CCBC in Northampton, then yes its real0 -
apologies if i sound stupid:( just getting to grips with the site. Ive read the info as asked. lots of good info about appeals etc but i cant find info relating to after that process.
what do you mean "acknowledge it online"?
does this letter mean i will haveto attend court?0 -
You should have been given a reference number. The letter from court will give details of how you log on and say you wish to defend the claim. Tick the box that says you wish to defend. Do not enter your defence at this point. You have time to read up more.
And yes, it is highly likely you will need to attend court.0 -

post #2 is not about appeals, its about court cases
the procedures are explained by member BARGEPOLE , also a solicitor called loadsofchildren123 too
please read it properly , especially post #2 as this applies to you0 -
oh goodness...really not good news then. Im considering paying up then as it may impact my job if i go to court etc. plus im completely daunted by that.
im trying hard to find info online. Conflicting views on whether i would win this case.
also if its saying its from Northampton then i would presume the court case would be there.0 -
ok thanks . will look again and check i read the correct thing0

as a nurse I would have thought you would not make general and incorrect assumptions and not presume either
the government has centres for various tasks , like the DVLA in Swansea and the Pension Centre in the North East etc
they have a central OFFICE in Northampton, it is NOT a court
if you go to court (civil court) , it will be one you nominate near you , so your local civil court
going to court will NOT impact your job , because it is a civil matter, not a criminal matter
if you lose , a judgment will be made by the judge (like RINDER) and you have 28 days to pay this judgment , IN FULL , otherwise you get a CCJ which impacts your credit rating (not your job)
this has nothing to do with your job , so take heed
PLEASE do the research and do not presume , do not make assumptions
this is not operation yewtree , its not a murder case, its not about negligence by a nurse in her profession (so not like that doctor case in london on the news today)
its a parking invoice , nothing more , the PPC are taking you to civil court for non-payment , same as a plumber would if he fitted your boiler and you did not pay his or her invoice , so please dont talk about it "impacting your job" !! - the only thing in danger is your purse0 -
Parking Eye are known to negotiate over payments. If you really can't face going to court you can haggle down the amount you pay.
The court will offer mediation as part of the process. Parking Eye have, in the past, settled for as little as £60.
You can negotiate right up to the second you walk into the court. Parking Eye often make a loss going to court so as it gets closer they tend to get more willing to settle.0 -
thanks for response-very fair points made and yes i shouldnt make assumptions.
wish i hadnt ignored it and just paid the initial £60 so lesson learnt!.Im not sure im up to speed with navigating my way around this site and finding sticky threads so cant find what im looking for atm-ill keep trying.
from what i gather atm i have 2 choices: either just pay it or register acknowledgement and go to court.0 -
