Some idiot keyed my hire car

    I'm not liable for my excess though as the cover ended?

    Therefore if the repair costs are more than my excess, I'll have to pay the full price right?

    Not looking for sympathy, just can't get my head around this being my fault.

    I think you need to talk to AVIS, and take it from there

    Nobody has said it's your fault, although knowing that it's not a safe area doesn't really help your case. There's a difference between being your fault and bearing responsibility.

    Never mind the website, why don't you read the contract you signed? I'd be surprised if that doesn't make clear who is responsible in your circumstances.

    Unfortunately, the contract does not state anything regarding these circumstances. I would imagine it's rare that Avis fail to collect on the date signed for, and infact will not collect for a further 48 hours?

    The contract wasn't broken and no negligence on the part of the hire company has taken place.

    Glentoran99 that's great, thank you so much.

    I think the fact I called, and remember the name of the woman I spoke to who advised that the driver is stuck in traffic and would not make the journey to collect as he "finishes at 1" , should work in my favour.

    The paperwork was signed by myself at 12pm and left in the vehicle as per their requirements (Ok I can't prove that I filled the paperwork in at 12, and that it was indeed damage free - but I guess they can't prove that I didn't?)

    Feeling a little more hopeful now, thank you.

    Then you need to speak to them and get them to take responsibility for the car over the next 48hrs.
