Well and the latest update in the roller coaster ride:
Monday is definitely not happening because it turns out (wait for it) that the other solicitors waited until they had everything else ready (i.e. today) to send the contract to the sellers to signAnd nothing but the original document back will suffice. It's almost comical, we signed ours WEEKS ago.
Did I mention the sellers are in France?0 -

I have said before, that surely someone could develop a sales portal and both parties could login and see the current status of the transaction. (i.e. who has any outstanding action, etc)0 -

@EndlessStruggle what a nightmare! I’m in a similar (ish) situation, buyers have pulled out because they spotted there is a risk of subsidence on one of the surveys. EA and their sols have tried to reach out to them to reassure them it isn’t an issue, but their messages and calls have been ignored. Back to the drawing board for us.0 -
I spoke with the neighbour, he's a lovely bloke and he explained it all to me.
I'm confident of what it is etc it's just whether they are happy with it or not.
Basically they moved the downpipe when they built their conservatory.
The manhole covers a bit of pipe that now serves their new downpipe after going along the back and under their conservatory.
The structure under the manhole forms part of the foundations of their conservatory.
It is likely the manhole was always there in some form on my property and I think they've moved it to a more convenient place up along the boundary.
They've always had drainage across the back of my plot, nowhere near the house.
The conveyance covers all this as we have a lot of overhanging structures, eaves and drainage etc.
My downpipe drains into the neighbours too.
It is clear from the searches that it isn't sewage or drainage from the house and this was confirmed by the owner too.
This is exhausting.

Just reading people's experiences here, both success and failure, just brings home how stressful this process is.
Our purchase is currently waiting to hear back from sellers if they'll accept our retainer terms. A situation their error (albeit an honest mistake) has pushed us to. They really should accept these terms imo but if I was them and I wanted to play as hardball as possible, I wouldn't, because I'd know that with the buyer's mortgage offer expiring, they stand to lose more. It's a high-stakes chess-game this, and I'm soooo tired with it.

No news on the amended mortgage paperwork yet, but I have now signed the TR1 forms and given them to my partner to get his bit signed and witnessed. Luckily for us I work for our conveyancing firm so will just take them into work with me on Monday. I've been advised to start moving deposit money too, so will do that Monday also.
Our conveyancer just wants everything in place so when we finally get this paperwork we are ready to exchange.1 -
Tonight, I feel totally defeated. I can’t quite believe that we have got so close to completing and the buyers pull out over something so common in surveys. Now I’m seriously wondering if they have found another house and were always going to pull out regardless. It all seems so ill timed.Just a little recap on my situation -
my mother died November last year (probate granted) brother currently living there. House needs to be sold as per wills instructions.Brother had an offer accepted back in March for a flat.Accepted an offer back in March for house. (FTB)
Pulled out end of June.
Brothers onward purchase agrees to wait.
House back on market July.
Offer accepted mid July.
Shouldn’t have been any hold ups but had one with restrictive covenant (questionable) which was blamed on buyers sols and we agreed to pay for indemnity insurance. Seemed to drag on.Now current FTB have pulled out because “only just noticed” house has subsidence risk (houses are just over 20 years old and no more of a risk than most other houses)
EA and buyers sols have suggested a structural survey. We have also suggested we will lower the agreed offer by 5k. No response all day today. EA emailed me to say he will try again tomorrow.The fact of the matter is, there is no forcing the issue. Accepting defeat and really not wanting to go through this again0
