Land Registry questions

Thanks for the quick reply, although I'm not sure I completely follow.
Person 1 - Me
Person 2
Person 3
Are you saying It is not possible to simply remove Person 1 - Me such that the property is now owned jointly by Person 2 and 3?
Or did I misunderstand? Can we complete the ‘transfer of whole of registered title’ form such that it is changed from the above to just being Person 2 and Person 3?
Thanks!0 -

The latter is correct so 1,2 and 3 can transfer the whole of the registered title to just 2 and 3 for example
You were referring to 'a third' and 'a share' and 'inheriting it back' so I was trying to make it clear that whilst you may be looking at it in that way that relates to the beneficial ownership or % share you may each have. It's the whole legal ownership which we deal with and which has to be transferred as a whole and not as a share e.g. 1 to 2 and 3 of a third share
Apologies if my reply confused matters for you“Official Company Representative

Hi.
We have a restriction registered against our property that we about to sell.
It's due to a IVA. The IVA has been completed and we have documentation today this.
How do we lift the restriction.
Also, how long does it take to process?
We were due to exchange contracts before Christmas, but the buyers solicitors have flagged this up. As we've completed on the IVA we never even thought about this 😰0 -
I applied (form OC2) for a document mentioned in a property Title - Charges Register:
"NOTE: Copy plan to conveyance filed under MX264855."
I received a letter back (your ref: NGL120528/OC/167/KJ) from LR stating:" HM Land Registry does not normally retain a copy of a deed when information from that deed is set out in the register."
However the wording in the register is meaningless without reference to the Plan.
Does the LR not retain the Plan?If not, why not, and if so, why was it not sent?I assume they took it as an application for a copy of the Deed itself, rather than the plan, hence the response given
The plan is not filed electronically so we would need to check whether it is in our paper records.
I can see the record of your application so I'll ask the processing office to double-check and write to you to confirm.
However I've heard and received nothing since.......0 -

You/your conveyancer should refer to section 8 of our Practice Guide on personal insolvency“Official Company Representative

Hi. Thanks for your earlier help, and yes, I had a call the next day to say the Plan would be pulled out of the paper records, which would take 24 hours.
However I've heard and received nothing since.......
Odd - we are having problems with some of our services at the moment but that only affects my ability to check in what's happened here. It shouldn't have impacted on the solution itself if that was applied last week or start of this one.
I'll post again as soon as I know more - really sorry“Official Company Representative

G_M I understand there was a delay in retrieving the paper file from central storage but that has now been received and the requested plan sent for scanning. Colleagues anticipate a copy will be issued on Monday and apologise for the delay and any inconvenience caused.“Official Company Representative

Hello,
We are buying a house and our solicitor requested from the seller`s solicitor to have a expired lease from the title removed. The lease says"Lease dated 13 june 1910 to r.d and a.j for 99 years from 25 march 1910.
Note: The lease comprises also other land."
the seller's solicitor has sent the application on the 27.11
L.R. asked further question on the 30.11
Solicitor answered on the 6.12
now there has been no movement ever since. is there a time table land registry has to fallow, or to they wait until last possible moment to answer? this is the only thing that is delaying our completion, every time i call land registry they only tell me a case worker has yet to look and see if all the documents are in order.0 -
Hi - when looking at a property to purchase we have been sent a MapSearch screenshot. This shows there are two Title numbers: xxxxxxx (which states 'pending first registration' and 'no details found' for the address) and xxxxx (which states 'freehold' and gives the correct address for the property). Does this mean the property has two title numbers which could make getting a mortgage on the property difficult? I have been told it is to do with crown land. Many thanks.0

This means that a piece of unregistered land is being registered. This could be for a number of reasons such as that piece of land has been recently transferred, the owner is voluntarily registering the land or it is subject to an adverse possession claim.
The unregistered piece of land may or may not be linked to the property you are purchasing.
Generally having two title numbers isn’t a problem as the mortgage will be registered against both. However it does mean that, if the unregistered bit is part of the property you are buying, that you may not be able to complete until the registration is complete.
Your solicitor should be able to explain whether the land is linked to the property you’re purchasing or not.0
